  1                      A bill to be entitled

  2         An act relating to driving privilege; providing

  3         a popular name; creating s. 318.1225, F.S.;

  4         providing additional charges for certain

  5         traffic violations; providing for distribution

  6         of moneys collected; amending s. 318.21, F.S.;

  7         revising provisions relating to disposition of

  8         civil penalties by county courts; creating s.

  9         322.287, F.S.; providing additional fee for

10         reinstatement of suspended driving privilege;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  This act shall be known by the popular name

16  the "Campbell, Slosberg, and Simmons Safety Act."

17         Section 2.  Section 318.1225, Florida Statutes, is

18  created to read:

19         318.1225  Additional charges for

20  violation.--Notwithstanding s. 318.121 and in addition to the

21  stated fines in s. 318.18, the court shall impose an

22  additional $50 for all moving and nonmoving traffic

23  infractions to be distributed as follows:

24         (1)  One dollar shall be remitted to the Department of

25  Revenue to be distributed to MADD Florida, to be used to fund

26  local victim services and education and awareness programs in

27  the state. The total amount distributed to MADD Florida under

28  this subsection shall not exceed $1 million per year. Any

29  amount collected in excess of $1 million shall be deposited

30  into the General Revenue Fund.

  1         (2)  Forty-nine dollars shall be remitted to the

  2  Department of Revenue to be deposited into the General Revenue

  3  Fund.

  4         Section 3.  Subsection (13) is added to section 318.21,

  5  Florida Statutes, to read:

  6         318.21  Disposition of civil penalties by county

  7  courts.--All civil penalties received by a county court

  8  pursuant to the provisions of this chapter shall be

  9  distributed and paid monthly as follows:

10         (13)  The additional charges on moving and nonmoving

11  traffic violations provided for under s. 318.1225 must be

12  collected and distributed by the clerk of the court as

13  provided in that section.

14         Section 4.  Section 322.287, Florida Statutes, is

15  created to read:

16         322.287  Reinstatement fees.--

17         (1)  In addition to any other fines, fees, or charges

18  imposed, the department shall impose an additional $50 fee for

19  reinstating and returning a license suspended pursuant to s.

20  322.27.

21         (2)  In addition to any other fines, fees, or charges

22  imposed, the department shall impose an additional $500 fee

23  for reinstating and returning a license suspended pursuant to

24  s. 322.2615 or s. 322.2616.

25         (3)  No driving privileges shall be reinstated until

26  complete payment of the applicable fees under this section.

27         (4)  All moneys collected pursuant to this section

28  shall be deposited into the General Revenue Fund.

29         Section 5.  This act shall take effect October 1, 2003.
