1 A bill to be entitled
2 An act relating to specialty license plates;
3 creating s. 320.08068, F.S.; creating a
4 specialty license plate for motorcycles;
5 providing for the distribution of annual use
6 fees received from the sale of such plates;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 320.08068, Florida Statutes, is
12 created to read:
13 320.08068 Motorcycle specialty license plates.--
14 (1) Notwithstanding the provisions of s. 320.08053,
15 the department shall develop a reduced dimensions specialty
16 license plate for display on motorcycles.
17 (2) The department shall issue a specialty license
18 plate to the owner or lessee of any motorcycle upon request
19 and payment of the appropriate license tax and fees.
20 (3) Each request must be made annually to the
21 department, accompanied by the following taxes and fees:
22 (a) The license tax required under s. 320.08.
23 (b) A license plate fee as required by s.
24 320.06(1)(b).
25 (c) A processing fee of $2.
26 (d) A license plate annual use fee as required in
27 subsection (4).
28 (4) A license plate annual use fee of $15 shall be
29 collected for each motorcycle specialty license plate. Annual
30 use fees shall be distributed to The Able Trust as custodial
31 agent. The Able Trust may retain a maximum of 10 percent of

1 the proceeds from the sale of the license plate for
2 administrative costs. The Able Trust shall distribute the
3 remaining funds as follows:
4 (a) Fifty percent to Florida Centers for Independent
5 Living in the form of matching grants from nongovernmental
6 sources;
7 (b) Twenty-five percent to Prevent Blindness Florida;
8 and
9 (c) Twenty-five percent to the Brain and Spinal Cord
10 Injury Program Trust Fund.

12 Funds distributed to the Florida Centers for Independent
13 Living must be used for programs and activities serving
14 disabled Floridians. A maximum of 10 percent of the proceeds
15 from the sale of the plate may be used for administrative
16 costs.
17 (5) If an owner or lessee to whom the department has
18 issued a motorcycle specialty license plate acquires a
19 replacement vehicle within the owner's registration period,
20 the department must authorize a transfer of the specialty
21 license plate to the replacement vehicle in accordance with s.
22 320.0609. The annual use fee or processing fee may not be
23 refunded.
24 (6) The license plate shall be 4 inches wide by 7
25 inches long and incorporate a red, white, and blue color
26 scheme approved by the department and may bear the imprint of
27 numerals from 1 to 999, inclusive, capital letters "A" through
28 "Z," or a combination thereof. The department shall determine
29 the maximum number of characters, including numerals and
30 letters. Motorcycle specialty license plates must be otherwise
31 of the same material as standard license plates issued for any

1 registration period. In small letters, the word "Florida" must
2 appear at the top of the plate.
3 (7) The department may issue personalized prestige
4 plates for license plates authorized in this section. Such
5 plates shall be issued in accordance with applicable
6 provisions contained in s. 320.0805.
7 Section 2. This act shall take effect July 1, 2003.

12 The CS clarifies 10 percent of the proceeds from the sale of
the plate may be used for administrative costs.

The CS also corrects a reference in order to properly name the
14 Brain and Spinal Cord Injury Program Trust Fund.
