1 A bill to be entitled
2          An act relating to the Lake County Water Authority,
3    formerly known as the Oklawaha Basin Recreation and Water
4    Conservation and Control Authority, Lake County; amending
5    ch. 29222, Laws of Florida, 1953, as amended; providing
6    conditions for the authority's election of officers;
7    providing an effective date.

9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Section 4 of chapter 29222, Laws of Florida,
12    1953, as amended by chapters 57-1484, 59-1466, 63-1507, 65-1787,
13    69-1209, and 2000-492, Laws of Florida, is amended to read:
14          Section 4. A governing body for the Authority is created,
15    consisting of seven members who are residents of Lake County,
16    which body shall be known and designated as the "Board of
17    Trustees of the Lake County Water Authority," but which shall be
18    referred to as "the board." Five of the members must each reside
19    in a geographic area identical to a county commission district,
20    to be elected by the electors of the county at large. Two of the
21    members will be elected by the electors of the county at large
22    without regard to their residence. On the second Tuesday
23    following the general election in 2000, the term of office of
24    each person serving on the board immediately before that date
25    expires, and the members of the board shall be elected by the
26    electors of Lake County in nonpartisan elections conducted by
27    the supervisor of elections pursuant to section 189.405, Florida
28    Statutes, in accordance with the Florida Election Code, chapters
29    97 through 106, Florida Statutes, beginning with the general
30    election in 2000, for terms of 4 years beginning on the second
31    Tuesday following the general election. For purposes of
32    staggering terms, the members elected in 2000 from odd-numbered
33    areas and the at-large member receiving the higher number of
34    votes shall be elected to 4-year terms and the members elected
35    from even-numbered areas and the at-large member receiving the
36    lower number of votes shall be elected to 2-year terms.
37    Thereafter, each member shall be elected for a term of 4 years,
38    except that a person may not be elected to more than two
39    consecutive 4-year terms. At the first meeting in December of
40    each year or, during a year in which there is a general
41    election, at a meeting held no later than 30 days after the
42    general election if the meeting and the election of officers
43    have been advertised properly,the board shall select one of
44    their number as Chair and one as Vice Chair of the board. The
45    Clerk of the Circuit Court of Lake County shall act as Secretary
46    and Treasurer of the board without any additional compensation.
47    In the event the provision pertaining to the duties of the Clerk
48    of the Circuit Court is for any reason held to be invalid, the
49    board may select one of its members to serve as its Secretary
50    and Treasurer, or it may appoint a nonmember of the board as its
51    Secretary and Treasurer and such nonmember shall receive
52    compensation commensurate with the responsibilities as
53    determined by the board. The board shall select a nonmember to
54    serve as Executive Director of the Authority, and such nonmember
55    shall receive compensation commensurate with the
56    responsibilities as determined by the board. The board shall
57    require a surety bond of any person, including the Clerk of the
58    Circuit Court, who shall act as Secretary and Treasurer of the
59    board, in an amount to be fixed by the board, which bond in the
60    case of the appointment of the Clerk of the Circuit Court or a
61    member of the board shall be in addition to the bond furnished
62    by such person as Clerk of the Circuit Court or as a member of
63    the board, and the premium thereon shall be paid by the board as
64    a necessary expense of operation.
65          Section 2. This act shall take effect upon becoming a law.
