11 Senator Smith moved the following amendment:

14 On page 50, line 20, through page 52, line 9, delete
15 those lines
16
17 and insert: (6) One hundred dollars or the fine amount
18 designated by county ordinance, plus court costs for illegally
19 parking, under s. 316.1955, in a parking space provided for
20 people who have disabilities. However, this fine will be
21 waived if a person provides to the law enforcement agency that
22 issued the citation for such a violation proof that the person
23 committing the violation has a valid parking permit or license
24 plate issued pursuant to s. 316.1958, s. 320.0842, s.
25 320.0843, s. 320.0845, or s. 320.0848 or a signed affidavit
26 that the owner of the disabled parking permit or license plate
27 was present at the time the violation occurred, and that such
28 a parking permit or license plate was valid at the time the
29 violation occurred. The law enforcement officer, upon
30 determining that all required documentation has been submitted
31 verifying that the required parking permit or license plate

1 was valid at the time of the violation, must sign an affidavit
2 of compliance. Upon provision of the affidavit of compliance
3 and payment of a $7.50 $5 dismissal fee to the clerk of the
4 circuit court, the clerk shall dismiss the citation.
5 (7) One hundred dollars for a violation of s.
6 316.1001. However, a person may elect to pay $30 to the clerk
7 of the court, in which case adjudication is withheld, and no
8 points are assessed under s. 322.27. Upon receipt of the fine,
9 the clerk of the court must retain $5 for administrative
10 purposes and must forward the $25 to the governmental entity
11 that issued the citation. Any funds received by a governmental
12 entity for this violation may be used for any lawful purpose
13 related to the operation or maintenance of a toll facility.
14 (11)(a) Court costs that are to be in addition to the
15 stated fine shall be imposed by the court in an amount not
16 less than the following:

18 For pedestrian infractions................................$ 3.
19 For nonmoving traffic infractions...................$ 16 $ 6.
20 For moving traffic infractions................................
21 $ 30 $ 10.

23 (b) In addition to the court cost assessed under
24 paragraph (a), the court shall impose a $3 court cost for each
25 infraction to be distributed as provided in s. 938.01 and a $2
26 court cost as provided in s. 938.15 when assessed by a
27 municipality or county.

29 Court costs imposed under this subsection may not exceed $30.
30 A criminal justice selection center or other local criminal
31 justice access and assessment center may be funded from these
