11          An act relating to specialty license plates; amending s.
12    320.08056, F.S.; providing an annual use fee for the
13    Protect Our Reefs license plate; amending s. 320.08058,
14    F.S.; revising distribution of annual use fees received
15    from the sale of Florida Arts license plates; creating the
16    Protect Our Reefs license plate; providing for the
17    distribution of annual use fees received from the sale of
18    such plates; providing for audit by the Auditor General;
19    providing an effective date.

21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. Paragraph (mm) is added to subsection (4) of
24    section 320.08056, Florida Statutes, to read:
25          320.08056 Specialty license plates.--
26          (4) The following license plate annual use fees shall be
27    collected for the appropriate specialty license plates:
28          (mm) Protect Our Reefs license plate, $25.
29          Section 2. Paragraph (b) of subsection (12) of section
30    320.08058, Florida Statutes, is amended, and subsection (39) is
31    added to said section, to read:
32          320.08058 Specialty license plates.--
33          (12) FLORIDA ARTS LICENSE PLATES.--
34          (b) The license plate annual use fees are to be annually
35    distributed pursuant to this paragraph. All fees collected must
36    be forwarded quarterly to the single arts council officially
37    designated by the county in direct proportion to the amounts of
38    fees collected in each county. If there is no county arts
39    council, then fees collected must be forwarded to such other
40    agency in the county as the highest ranking county
41    administrative official designates, to be applied by the arts
42    council or agency to support arts organizations, arts programs,
43    and arts activities within the county.as follows:
44          1. All fees collected must be forwarded quarterly to the
45    Division of Cultural Affairs of the Department of State,
46    together with a report setting forth the amount of such fees
47    collected in each county, and must be deposited into the Florida
48    Fine Arts Trust Fund.
49          2. The Division of Cultural Affairs shall distribute the
50    fees forwarded to it by the department to the counties in the
51    amounts set forth in the report required under subparagraph 1.,
52    in each case to the county arts council for such county or, if
53    there is none, to such other agency in the county as the
54    division designates, to be applied by the council or agency to
55    support art organizations, programs, and activities within the
56    county.
57          (39) PROTECT OUR REEFS LICENSE PLATES.--
58          (a) The department shall develop a Protect Our Reefs
59    license plate as provided in this section. Protect Our Reefs
60    license plates must bear the colors and design approved by the
61    department. The word "Florida" must appear at the top of the
62    plate, and the words "Protect Our Reefs" must appear at the
63    bottom of the plate.
64          (b) The proceeds of the annual use fee shall be
65    distributed to Mote Marine Laboratory, Inc., to fund Florida
66    reef research, conservation, and education programs. Up to 15
67    percent of the funds received by Mote Marine Laboratory, Inc.,
68    may be expended for annual administrative costs directly
69    associated with the administration of the Protect Our Reefs
70    program. Up to 10 percent of the funds received by Mote Marine
71    Laboratory, Inc., may be used by Mote Marine Laboratory, Inc.,
72    for the continuing promotion and marketing of the license plate.
73    After reimbursement for documented costs expended in the
74    establishment of the plate, Mote Marine Laboratory, Inc., shall
75    use and distribute the remaining funds to eligible Florida-based
76    scientific, conservation, and education organizations for the
77    collection, analysis, and distribution of scientific,
78    educational, and conservation information to the research
79    community; federal, state, and local government agencies;
80    educational institutions; and the public. Eligible organizations
81    shall be based in Florida and engaged in reef research,
82    conservation, or education.
83          (c) The state Auditor General may examine any records of
84    Mote Marine Laboratory, Inc., and any other organization that
85    receives funds from the sale of the Protect Our Reefs license
86    plate, to determine compliance with law.
87          Section 2. This act shall take effect July 1, 2003.
88
