12    changing the names of Chipola Junior College and Miami-
13    Dade Community College to Chipola College and Miami-Dade
14    College, respectively; amending ss. 288.8175 and 1002.35,
15    F.S.; conforming provisions; amending s. 1004.73, F.S.;
16    requiring Miami-Dade College and Chipola College to seek
17    accreditation as baccalaureate degree granting colleges;
18    providing requirements relating to mission, policies,
19    student fees, degrees, governance, employment, facilities,
20    and funding; amending s. 1004.76, F.S., relating to the
21    Florida Martin Luther King, Jr., Institute for
22    Nonviolence; deleting a provision relating to the
23    establishment of said institute at Miami-Dade Community
24    College; providing an effective date.

26          Be It Enacted by the Legislature of the State of Florida:
27         
28          Section 1. Paragraphs (d) and (o) of subsection (3) of
29    section 1000.21, Florida Statutes, are amended to read:
30          1000.21 Systemwide definitions.--As used in the Florida K-
31    20 Education Code:
32          (3) "Community college," except as otherwise specifically
33    provided, includes the following institutions and any branch
34    campuses, centers, or other affiliates of the institution:
35          (d) Chipola JuniorCollege.
36          (o) Miami-Dade CommunityCollege.
37          Section 2. Paragraphs (a) and (g) of subsection (5) of
38    section 288.8175, Florida Statutes, are amended to read:
39          288.8175 Linkage institutes between postsecondary
40    institutions in this state and foreign countries.--
41          (5) The institutes are:
42          (a) Florida-Brazil Institute (University of Florida and
43    Miami-Dade CommunityCollege).
44          (g) Florida-France Institute (New College of the
45    University of South Florida, Miami-Dade CommunityCollege, and
46    Florida State University).
47          Section 3. Paragraph (a) of subsection (2) of section
48    1002.35, Florida Statutes, is amended to read:
49          1002.35 New World School of the Arts.--
50          (2)(a) For purposes of governance, the New World School of
51    the Arts is assigned to Miami-Dade CommunityCollege, the Dade
52    County School District, and one or more universities designated
53    by the State Board of Education. The State Board of Education
54    shall assign to the New World School of the Arts a university
55    partner or partners. In this selection, the State Board of
56    Education shall consider the accreditation status of the core
57    programs. Florida International University, in its capacity as
58    the provider of university services to Dade County, shall be a
59    partner to serve the New World School of the Arts, upon meeting
60    the accreditation criteria. The respective boards shall appoint
61    members to an executive board for administration of the school.
62    The executive board may include community members and shall
63    reflect proportionately the participating institutions. Miami-
64    Dade CommunityCollege shall serve as fiscal agent for the
65    school.
66          Section 4. Section 1004.73, Florida Statutes, is amended
67    to read:
68          1004.73 St. Petersburg College; Miami-Dade College;
69    Chipola College.--
70          (1) LEGISLATIVE INTENT.--The Legislature intends to create
71    an innovative means to increase access to baccalaureate degree
72    level education in populous counties that are underserved by
73    public baccalaureate degree granting institutions. This
74    education is intended to address the state's workforce needs,
75    especially the need for teachers, nurses, and business managers
76    in agencies and firms that require expertise in technology.
77          (2) ST. PETERSBURG COLLEGE; MIAMI-DADE COLLEGE; CHIPOLA
78    COLLEGE; MISSION; POLICIES.--St. Petersburg College, Miami-Dade
79    College, and Chipola Collegeshall immediately seek
80    accreditation from the Southern Association of Colleges and
81    Schools as a baccalaureate degree granting collegescollege.
82          (a) The primary mission of St. Petersburg College, Miami-
83    Dade College, and Chipola Collegeis to provide high-quality
84    undergraduate education at an affordable price for students and
85    the state. The purpose is to promote economic development by
86    preparing people for occupations that require a bachelor's
87    degree and are in demand by existing or emerging public and
88    private employers in this state.
89          (b) St. Petersburg College, Miami-Dade College, and
90    Chipola Collegeshall maintain the mission and policies of a
91    Florida community college, including the open-door admissions
92    policy and the authority to offer all programs consistent with a
93    community college's authority.
94          (c) St. Petersburg College shall maintain the distinction
95    between the college and its university center. St. Petersburg
96    College is limited to community college programs and to selected
97    baccalaureate degree level programs that meet community needs
98    and are authorized as provided by this section. The University
99    Center may make available more diverse program offerings, but
100    those programs are offered by a participating college or
101    university and are not to be classified or funded as programs of
102    St. Petersburg College.
103          (d) The academic policies of the upper-division programs
104    program at St. Petersburg College, Miami-Dade College, and
105    Chipola Collegemust be in accordance with policies of the State
106    Board of Education.
107          (e) Sections 1013.39 and 1013.82 apply to St. Petersburg
108    College, Miami-Dade College, and Chipola College.
109          (3) STUDENTS; FEES.--
110          (a) St. Petersburg College, Miami-Dade College, and
111    Chipola Collegeshall maintain separate records for students who
112    are enrolled in courses classified in the upper division and
113    lower division of a baccalaureate program, according to the
114    statewide course numbering system. A student shall be reported
115    as a community college student for enrollment in a lower-
116    division course and as a baccalaureate degree program student
117    for enrollment in an upper-division course.
118          (b) The Board of Trustees of St. Petersburg College, the
119    Board of Trustees of Miami-Dade College, and the Board of
120    Trustees of Chipola Collegeshall establish the level of tuition
121    and other authorized student fees consistent with law and
122    proviso in the General Appropriations Act.
123          1. For each credit hour of enrollment in a certificate
124    level course or lower-division level college credit course,
125    tuition and fees must be within the range authorized in law and
126    rule for a community college student at that level.
127          2. For each credit hour of enrollment in an upper-division
128    level course, matriculation and tuition fees must be in an
129    amount established by the Board of Trustees of St. Petersburg
130    College, the Board of Trustees of Miami-Dade College, and the
131    Board of Trustees of Chipola College. However, fees for upper-
132    division students must reflect the fact that the college does
133    not incur the costs of major research programs. Therefore, the
134    board of trustees shall establish fees for upper-division
135    students within a range that is lower than the fees established
136    for students at a state university but higher than the fees for
137    community college students.
138          3. Other mandatory fees and local fees must be at the same
139    level for all lower-division students. For upper-division
140    students, other mandatory fees and local fees must be at a level
141    less than fees established for state university of South Florida
142    students, regardless of program enrollment or level. However,
143    students in workforce development education courses maintain the
144    authorized fee exemptions described in s. 1009.25 and may be
145    exempt from local fees imposed by the board of trustees, at the
146    board's discretion.
147          (4) DEGREES.--
148          (a) In addition to the certificates, diplomas, and degrees
149    authorized in s. 1004.65, St. Petersburg College may offer
150    selected baccalaureate degrees. Initially, the college may offer
151    programs that lead to a baccalaureate degree in the following
152    fields:
153          1. Bachelor of Science in Nursing. This program must be
154    designed to articulate with the associate in science degree in
155    nursing. St. Petersburg College shall continue to offer the
156    associate in science degree in nursing.
157          2. Bachelor of Arts and Bachelor of Science in Elementary
158    Education.
159          3. Bachelor of Arts and Bachelor of Science in Special
160    Education.
161          4. Bachelor of Arts and Bachelor of Science in Secondary
162    Education.
163          5. Bachelor of Applied Science in fields selected by the
164    Board of Trustees of St. Petersburg College. The board of
165    trustees shall base the selection on an analysis of workforce
166    needs and opportunities in the following counties: Pinellas,
167    Pasco, Hernando, and other counties approved by the Department
168    of Education. For each program selected, St. Petersburg College
169    must offer a related associate in science or associate in
170    applied science degree program, and the baccalaureate degree
171    level program must be designed to articulate fully with at least
172    one associate in science degree program. The college is
173    encouraged to develop articulation agreements for enrollment of
174    graduates of related associate in applied science degree
175    programs.
176          (b) Miami-Dade College obtained approval by the State
177    Board of Education to grant baccalaureate degrees in education
178    in the areas of exceptional student education and secondary
179    education in science and mathematics pursuant to s.
180    1007.33(3)(b). In addition to the certificates, diplomas, and
181    degrees authorized in s. 1004.65, Miami-Dade College may offer
182    selected baccalaureate degrees. Initially, the college may offer
183    programs that lead to a baccalaureate degree in the following
184    fields:
185          1. Bachelor of Arts and Bachelor of Science in Exceptional
186    Student Education.
187          2. Bachelor of Arts and Bachelor of Science in Secondary
188    Education.
189         
190          Miami-Dade College may offer additional baccalaureate degrees as
191    approved by the State Board of Education.
192          (c) Chipola College obtained approval by the State Board
193    of Education to grant baccalaureate degrees in education in the
194    area of secondary education pursuant to s. 1007.33(3)(b). In
195    addition to the certificates, diplomas, and degrees authorized
196    in s. 1004.65, Chipola College may offer selected baccalaureate
197    degrees. Initially, the college may offer programs that lead to
198    a Bachelor of Arts in Secondary Education.
199          (d)(b) St. Petersburg College, Miami-Dade College, and
200    Chipola Collegemay offer courses that enable teachers to
201    qualify for certification and recertification as required by law
202    or rule.
203          (e)(c) St. Petersburg College, Miami-Dade College, and
204    Chipola Collegemay offer programs to provide opportunities for
205    a person who holds a baccalaureate degree, but is not certified
206    to teach, to obtain any additional courses required for teacher
207    certification.
208          (f)(d)Master's degree level programs and doctoral
209    programs may be provided by agreement with a college or
210    university participating in the University Center of St.
211    Petersburg College.
212          (g)(e)For those students living outside Pinellas County,
213    St. Petersburg College shall recruit for the upper division only
214    those students who have earned an associate degree. In
215    recruiting upper-division students in Pasco and Hernando
216    Counties, St. Petersburg College shall work cooperatively with
217    Pasco-Hernando Community College and shall seek to offer courses
218    and programs at Pasco-Hernando Community College when feasible.
219    The nursing programs, in particular, must be conducted
220    cooperatively, and programs at St. Petersburg College shall not
221    conflict with Pasco-Hernando Community College's and the
222    University of South Florida's cooperative nursing program.
223          (5) BOARDS.--
224          (a) The Board of Trustees of St. Petersburg College, the
225    Board of Trustees of Miami-Dade College, and the Board of
226    Trustees of Chipola College serveserves as the college's
227    governing boards of the collegesboard. The Governor shall
228    appoint members as provided in s. 1001.61, and the boards shall
229    haveboard hasthe duties and authorities granted in ss. 1001.63
230    and 1001.64 and by rules of the State Board of Education.
231          (b) The Board of Trustees of St. Petersburg College, the
232    Board of Trustees of Miami-Dade College, and the Board of
233    Trustees of Chipola Collegemay authorize direct-support
234    organizations as authorized in ss. 1004.28 and 1004.70.
235          (c) The Board of Trustees of St. Petersburg College may
236    continue to award degrees, diplomas, and certificates as
237    authorized for St. Petersburg Junior College, and in the name of
238    St. Petersburg Junior College, until St. Petersburg College
239    receives its accreditation.
240          (d) The Board of Trustees of Miami-Dade College may
241    continue to award degrees, diplomas, and certificates as
242    authorized for Miami-Dade Community College, and in the name of
243    Miami-Dade Community College, until Miami-Dade College receives
244    its accreditation.
245          (e) The Board of Trustees of Chipola College may continue
246    to award degrees, diplomas, and certificates as authorized for
247    Chipola Junior College, and in the name of Chipola Junior
248    College, until Chipola College receives its accreditation.
249          (f)(d)A coordinating board shall assist the Board of
250    Trustees of St. Petersburg Collegein its deliberations
251    concerning issues that affect the upper division of St.
252    Petersburg College. The coordinating board consists of the
253    President of the University of South Florida, the President of
254    St. Petersburg College, the President of Pasco-Hernando
255    Community College, and the chairs of the boards of trustees of
256    those institutions.
257          1.(e)Beginning 4 years after the college receives
258    accreditation to offer baccalaureate degrees, the Board of
259    Trustees of St. Petersburg College may determine additional
260    programs to be offered, with the approval of the coordinating
261    board. The determination must consider community needs and
262    economic opportunities.
263          2.(f)The coordinating board shall meet at the request of
264    the President of the University of South Florida or the
265    President of St. Petersburg College.
266          3.(g)If the coordinating board cannot decide an issue of
267    importance to the programs designed for upper-division students,
268    the State Board of Education shall resolve the issue.
269          (6) EMPLOYEES.--
270          (a) Employment at St. Petersburg College, Miami-Dade
271    College, and Chipola Collegeis governed by the same laws that
272    govern community colleges, except that upper-division faculty at
273    St. Petersburg Collegeare eligible for continuing contracts
274    upon the completion of the fifth year of teaching.
275          (b) Employee records for all personnel shall be maintained
276    as required by s. 1012.81.
277          (7) FACILITIES.--
278          (a)St. Petersburg College may request funding from the
279    Public Education Capital Outlay and Debt Service Trust Fund as a
280    community college and as a university. The municipalities in
281    Pinellas County, the Board of County Commissioners of Pinellas
282    County, and all other governmental entities are authorized to
283    cooperate with the Board of Trustees of St. Petersburg College
284    in establishing this institution. The acquisition and donation
285    of lands, buildings, and equipment for the use of St. Petersburg
286    College are authorized as a public purpose. The Board of County
287    Commissioners of Pinellas County and all municipalities in
288    Pinellas County may exercise the power of eminent domain to
289    acquire lands, buildings, and equipment for the use of St.
290    Petersburg College, regardless of whether such lands, buildings,
291    and equipment are located in a community redevelopment area.
292          (b) Miami-Dade College may request funding from the Public
293    Education Capital Outlay and Debt Service Trust Fund as a
294    community college and as a university. The municipalities in
295    Miami-Dade County, the Board of County Commissioners of Miami-
296    Dade County, and all other governmental entities are authorized
297    to cooperate with the Board of Trustees of Miami-Dade College in
298    establishing this institution. The acquisition and donation of
299    lands, buildings, and equipment for the use of Miami-Dade
300    College are authorized as a public purpose. The Board of County
301    Commissioners of Miami-Dade County and all municipalities in

306          (c) Chipola College may request funding from the Public
307    Education Capital Outlay and Debt Service Trust Fund as a
308    community college and as a university. The municipalities in
309    Jackson, Liberty, Holmes, Calhoun, and Washington Counties, the
310    Boards of County Commissioners of Jackson, Liberty, Holmes,
311    Calhoun, and Washington Counties, and all other governmental
312    entities are authorized to cooperate with the Board of Trustees
313    of Chipola College in establishing this institution. The
314    acquisition and donation of lands, buildings, and equipment for
315    the use of Chipola College are authorized as a public purpose.
316    The Boards of County Commissioners of Jackson, Liberty, Holmes,
317    Calhoun, and Washington Counties and all municipalities in those
318    counties may exercise the power of eminent domain to acquire
319    lands, buildings, and equipment for the use of Chipola College,
320    regardless of whether such lands, buildings, and equipment are
321    located in a community redevelopment area.
322          (8) STATE FUNDING.--
323          (a) The Legislature intends to fund St. Petersburg
324    College, Miami-Dade College, and Chipola College as a community
325    collegescollege for theiritsworkforce development education
326    programs and for theiritslower-division level college credit
327    courses and programs.
328          (b) The Legislature intends to fund St. Petersburg
329    College, Miami-Dade College, and Chipola College as a
330    baccalaureate degree level institutionsinstitution for their
331    itsupper-division level courses and programs.
332          Section 5. Subsection (2) of section 1004.76, Florida
333    Statutes, is amended to read:
334          1004.76 Florida Martin Luther King, Jr., Institute for
335    Nonviolence.--
336          (2) There is hereby created the Florida Martin Luther
337    King, Jr., Institute for Nonviolence to be established at Miami-
338    Dade Community College. The institute shall have an advisory
339    board consisting of 13 members as follows: the Attorney General,
340    the Commissioner of Education, and 11 members to be appointed by
341    the Governor, such members to represent the population of the
342    state based on its ethnic, gender, and socioeconomic diversity.
343    Of the members appointed by the Governor, one shall be a member
344    of the Senate appointed by the Governor on the recommendation of
345    the President of the Senate; one shall be a member of the Senate
346    appointed by the Governor on the recommendation of the minority
347    leader; one shall be a member of the House of Representatives
348    appointed by the Governor on the recommendation of the Speaker
349    of the House of Representatives; one shall be a member of the
350    House of Representatives appointed by the Governor on the
351    recommendation of the minority leader; and seven shall be
352    members appointed by the Governor, no more than three of whom
353    shall be members of the same political party. The following
354    groups shall be represented by the seven members: the Florida
355    Sheriffs Association; the Florida Association of Counties; the
356    Florida League of Cities; state universities human services
357    agencies; community relations or human relations councils; and
358    youth. A chairperson shall be elected by the members and shall
359    serve for a term of 3 years. Members of the board shall serve
360    the following terms of office which shall be staggered:
361          (a) A member of the Legislature appointed to the board
362    shall serve for a single term not to exceed 5 years and shall
363    serve as a member only while he or she is a member of the
364    Legislature.
365          (b) Of the seven members who are not members of the
366    Legislature, three shall serve for terms of 4 years, two shall
367    serve for terms of 3 years, and one shall serve for a term of 1
368    year. Thereafter, each member, except for a member appointed to
369    fill an unexpired term, shall serve for a 5-year term. No member
370    shall serve on the board for more than 10 years.

372          In the event of a vacancy occurring in the office of a member of
373    the board by death, resignation, or otherwise, the Governor
374    shall appoint a successor to serve for the balance of the
375    unexpired term.
376          Section 6. This act shall take effect July 1, 2003.
