persons who plead guilty or nolo contendere to, or who are |

found guilty of, certain crimes against minors; requiring |

the clerk of the court to deposit the proceeds of the |
16
|
court cost into the State Treasury for deposit into a |
17
|
specified trust fund to be used to fund children's |
18
|
advocacy centers; requiring the clerk of the court to |
19
|
retain a portion of the court cost as a service charge; |
20
|
requiring annual reports; requiring a report to the |
21
|
Legislature; providing an effective date. |

|
Be It Enacted by the Legislature of the State of Florida: |
24
|
|

|
Section 1. Section 938.10, Florida Statutes, is created to |
26
|
read: |
27
|
938.10 Additional court cost imposed in cases of certain |
28
|
crimes against minors.-- |
29
|
(1) If a person pleads guilty or nolo contendere to, or is |
30
|
found guilty of, regardless of adjudication, any offense against |
31
|
a minor in violation of s. 784.085, chapter 787, chapter 794, s. |
32
|
796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.4045, the |
33
|
court shall impose a court cost of $101 against the offender in |
34
|
addition to any other cost or penalty required by law. |

|
(2) Each month the clerk of the court shall transfer the |
36
|
proceeds of the court cost, less $1 from each sum collected, |
37
|
which the clerk shall retain as a service charge, to the State |
38
|
Treasury for deposit into the Child Advocacy Trust Fund for |
39
|
disbursement to the Florida Network of Children's Advocacy |
40
|
Centers, Inc., for the purpose of funding children's advocacy |
41
|
centers that are members of the network. |

(3) At the end of each fiscal year each children's |
43
|
advocacy center receiving revenue from the Child Advocacy Trust |
44
|
Fund must provide a report to the Board of Directors of the |
45
|
Florida Network of Children's Advocacy Centers, Inc., which |
46
|
reflects center expenditures, all sources of revenue received, |
47
|
and outputs that have been standardized and agreed upon by |
48
|
network members and the board of directors, such as the number |
49
|
of clients served, client demographic information, and number |
50
|
and types of services provided. The Florida Network of |
51
|
Children's Advocacy Centers, Inc., must compile reports from the |
52
|
centers and provide a report to the President of the Senate and |
53
|
the Speaker of the House of Representatives in August of each |
54
|
year beginning in 2004. |

|
Section 2. This act shall take effect July 1, 2003. |
