re-creation of the trust fund; providing a contingent |

effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. Child Advocacy Trust Fund.-- |
13
|
(1) The Child Advocacy Trust Fund is created within the |
14
|
Department of Children and Family Services. The purpose of the |
15
|
trust fund is to receive funds pursuant to s. 938.10, Florida |
16
|
Statutes, which shall be disbursed in equal amounts to child |
17
|
advocacy centers that are members of the Florida Network of |
18
|
Children's Advocacy Centers, Inc., as established under s. |
19
|
39.3035, Florida Statutes. |

(2) Notwithstanding s. 216.301, Florida Statutes, and |
21
|
pursuant to s. 216.351, Florida Statutes, any balance in the |
22
|
trust fund at the end of any fiscal year shall remain in the |
23
|
trust fund at the end of the year and shall be available for |
24
|
carrying out the purposes of the trust fund. |

(3) Pursuant to s. 19(f)(2), Art. III of the State |
26
|
Constitution, the trust fund shall, unless terminated sooner, be |
27
|
terminated on July 1, 2007. Before its scheduled termination, |
28
|
the trust fund shall be reviewed as provided in s. 215.3206(1) |
29
|
and (2), Florida Statutes. |

Section 2. This act shall take effect July 1, 2003, if |
31
|
House Bill 1533 or similar legislation is adopted in the same |
32
|
legislative session or an extension thereof and becomes law. |
