| 1 | A bill to be entitled | ||
| 2 | An act relating to optional medical assistance and related | ||
| 3 | services payments; amending s. 409.904, F.S.; providing | ||
| 4 | for Medicaid eligibility for certain disabled persons | ||
| 5 | under a Medicaid buy-in program, subject to specific | ||
| 6 | federal authorization; providing an effective date. | ||

| 8 | Be It Enacted by the Legislature of the State of Florida: | ||
| 9 | |||
| 10 | Section 1. Subsection (11) is added to section 409.904, | ||
| 11 | Florida Statutes, to read: | ||
| 12 | 409.904 Optional payments for eligible persons.--The | ||
| 13 | agency may make payments for medical assistance and related | ||
| 14 | services on behalf of the following persons who are determined | ||
| 15 | to be eligible subject to the income, assets, and categorical | ||
| 16 | eligibility tests set forth in federal and state law. Payment | ||
| 17 | on behalf of these Medicaid eligible persons is subject to the | ||
| 18 | availability of moneys and any limitations established by the | ||
| 19 | General Appropriations Act or chapter 216. | ||
| 20 | (11) Subject to specific federal authorization, a person | ||
| 21 | who, but for earnings in excess of the limit established under | ||
| 22 | s. 1905(q)(2)(B) of the Social Security Act, would be considered | ||
| 23 | for receiving supplemental security income, who is at least 16 | ||
| 24 | but less than 65 years of age, and whose assets, resources, and | ||
| 25 | earned or unearned income, or both, do not exceed 250 percent of | ||
| 26 | the most current federal poverty level. Such persons may be | ||
| 27 | eligible for Medicaid services as part of a Medicaid buy-in | ||
| 28 | established under s. 409.914(2) specifically designed to | ||
| 29 | accommodate those persons made eligible for such a buy-in by | ||
| 30 | Title II of Pub. L. No. 106-170. Such buy-in shall include | ||
| 31 | income-related premiums and cost sharing. | ||
| 32 | Section 2. This act shall take effect July 1, 2003. | ||
