| 12 | services payments; amending s. 409.904, F.S.; authorizing | ||
| 13 | use of funds for Medicaid for certain persons; providing | ||
| 14 | eligibility criteria; providing income and asset | ||
| 15 | limitations; providing an effective date. | ||

| 17 | Be It Enacted by the Legislature of the State of Florida: | ||
| 18 | |||
| 19 | Section 1. Subsection (11) is added to section 409.904, | ||
| 20 | Florida Statutes, to read: | ||
| 21 | 409.904 Optional payments for eligible persons.--The | ||
| 22 | agency may make payments for medical assistance and related | ||
| 23 | services on behalf of the following persons who are determined | ||
| 24 | to be eligible subject to the income, assets, and categorical | ||
| 25 | eligibility tests set forth in federal and state law. Payment on | ||
| 26 | behalf of these Medicaid eligible persons is subject to the | ||
| 27 | availability of moneys and any limitations established by the | ||
| 28 | General Appropriations Act or chapter 216. | ||
| 29 | (11) Funds may be used to provide Medicaid to persons at | ||
| 30 | least 16 but less than 65 years of age who would be considered | ||
| 31 | eligible for supplemental security income but for earnings in | ||
| 32 | excess of the limit established under s. 1905(q)(2)(B) of Pub. | ||
| 33 | L. No. 106-170, and whose income does not exceed the income | ||
| 34 | limit specified in subsection (1) or a lower income limit as | ||
| 35 | specified by administrative rule. Earned income of up to 250 | ||
| 36 | percent of the federal poverty level, after application of the | ||
| 37 | supplemental security income earned income disregards, shall be | ||
| 38 | disregarded in determining eligibility. The asset limit shall be | ||
| 39 | $8,000 for an individual and $9,000 for a couple, excluding a | ||
| 40 | second vehicle, if there is a spouse living in the home, and all | ||
| 41 | funds placed in a retirement account recognized by the Internal | ||
| 42 | Revenue Service. | ||
| 43 | Section 2. This act shall take effect July 1, 2003. | ||
