1 A bill to be entitled
2          An act relating to Broward County; amending chapter 2001-
3    289, Laws of Florida; authorizing local governments in the
4    county to grant an exception from transportation impact
5    fees and exactions for certain developments; providing an
6    effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Section 1 of chapter 2001-289, Laws of Florida,
11    is amended to read:
12          Section 1. In addition to the exceptions provided in
13    section 163.3180(5)(b), Florida Statutes, a local government in
14          Broward County may grant an exception from transportation impact
15    fees and exactions and fromthe concurrency requirement for
16    transportation facilities pursuant to the provisions of section
17    163.3180(5)(d), Florida Statutes, if the proposed development is
18    otherwise consistent with the adopted local government
19    comprehensive plan, and is a project that promotes public
20    transportation and is located within a Regional Activity Center
21    as described in and defined by the Broward County Comprehensive
22    Plan, and is within an area that contains major public and
23    private postsecondary institutions of higher learning. The local
24    government also must have considered the proposed development's
25    impacts on the Florida Intrastate Highway System, as defined in
26    section 338.001, Florida Statutes. A local government in Broward
27    County may also grant an exemption from impact fees for
28    transportation facilities if a major public or private
29    postsecondary institution of higher learning has an interest or
30    an option to obtain an interest of more than 25 percent in the
31    proposed development and the proposed development is otherwise
32    consistent with the adopted local government comprehensive plan,
33    is a project that promotes public transportation, is located
34    within a Regional Activity Center as described in and defined by
35    the Broward County Comprehensive Plan, and is within an area
36    that contains major public and private postsecondary
37    institutions of higher learning.
38          Section 2. This act shall take effect upon becoming a law.
