1 A bill to be entitled
2          An act relating to Broward County; amending chapter 2001-
3    289, Laws of Florida; authorizing local governments in the
4    county to grant an exemption from impact fees for
5    transportation facilities for certain developments;
6    providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Section 1 of chapter 2001-289, Laws of Florida,
11    is amended to read:
12          Section 1. In addition to the exceptions provided in
13    section 163.3180(5)(b), Florida Statutes, a local government in
14          Broward County may grant an exception from the concurrency
15    requirement for transportation facilities pursuant to the
16    provisions of section 163.3180(5)(d), Florida Statutes, if the
17    proposed development is otherwise consistent with the adopted
18    local government comprehensive plan, and is a project that
19    promotes public transportation and is located within a Regional
20    Activity Center as described in and defined by the Broward
21    County Comprehensive Plan, and is within an area that contains
22    major public and private postsecondary institutions of higher
23    learning. The local government also must have considered the
24    proposed development's impacts on the Florida Intrastate Highway
25    System, as defined in section 338.001, Florida Statutes. A local
26    government in Broward County may also grant an exemption from
27    impact fees for transportation facilities if a major public or
28    private postsecondary institution of higher learning has an
29    interest or an option to obtain an interest of more than 25
30    percent in the proposed development and the proposed development
31    is otherwiseconsistent with the adopted local government
32    comprehensive plan, is a project that promotes public
33    transportation, is located within a Regional Activity Center as
34    described in and defined by the Broward County Comprehensive
35    Plan, and is within an area that contains major public and
36    private postsecondary institutions of higher learning.
37          Section 2. This act shall take effect upon becoming a law.
