4 activities of members of the Commission on
5 Ethics; providing exceptions; providing an

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (1) of section 112.321, Florida
11 Statutes, is amended to read:
12 112.321 Membership, terms; travel expenses; staff.--
13 (1) The commission shall be composed of nine members.
14 Five of these members shall be appointed by the Governor, no
15 more than three of whom shall be from the same political
16 party, subject to confirmation by the Senate. One member
17 appointed by the Governor shall be a former city or county
18 official and may be a former member of a local planning or
19 zoning board which has only advisory duties. Two members
20 shall be appointed by the Speaker of the House of
21 Representatives, and two members shall be appointed by the
22 President of the Senate. Neither the Speaker of the House of
23 Representatives nor the President of the Senate shall appoint
24 more than one member from the same political party. Of the
25 nine members of the Commission, no more than five members
26 shall be from the same political party at any one time. No
27 member may hold any public employment. An individual who
28 qualifies as a lobbyist pursuant to s. 11.045 or s. 112.3215
29 or any local government charter or ordinance, may not serve as
30 a member of the commission, except that this prohibition does
31 not apply to an individual who is a member of the commission

1 on July 1, 2003, until the expiration of his or her current
2 term. A member of the commission may not lobby any state or
3 local governmental entity as provided in s. 11.045 or s.
4 112.3215 or any local government charter or ordinance, except
5 that this prohibition does not apply to an individual who is a
6 member of the commission on July 1, 2003, until the expiration
7 of his or her current term. All members shall serve 2-year
8 terms. No member shall serve more than two full terms in
9 succession. Any member of the commission may be removed for
10 cause by majority vote of the Governor, the President of the
11 Senate, the Speaker of the House of Representatives, and the
12 Chief Justice of the Supreme Court.
13 Section 2. This act shall take effect October 1, 2003.
