2	An act relating to Okaloosa County; amending chapter 2000-
3	434, Laws of Florida; revising boundaries of the Baker
4	Fire District, Okaloosa County; amending chapter 2001-333,
5	Laws of Florida; revising boundaries of the North Okaloosa
6	Fire District; providing an effective date.

8	WHEREAS, the North Okaloosa Fire District and the Baker
9	Fire District are independent special fire districts created by
10	acts of the Florida Legislature, and
11	WHEREAS, an amendment to the local act that created the
12	Baker Fire District created an overlap regarding boundaries of a
13	portion of territory between the North Okaloosa Fire District
14	and the Baker Fire District, and
15	WHEREAS, the purpose of this act is to clarify and ratify
16	the agreements between the parties regarding fire district
17	boundaries, NOW, THEREFORE,

19	Be It Enacted by the Legislature of the State of Florida:
20
21	Section 1. Section 2 of section 2 of chapter 2000-434,
22	Laws of Florida, is amended to read:
23	Section 2. Creation; boundaries.--
24	(1) All of the following lands in Okaloosa County shall be
25	incorporated as an independent special fire control district,
26	which shall be a public municipal corporation for the public
27	benefit, with perpetual existence, to be known as the Baker Fire
28	District, in which name it may sue and be sued, and lease, own,
29	possess, and convey real and personal property, by purchase or
30	gift or otherwise, to carry out the purposes of this act. The
31	lands so incorporated shall include the following:

33	Begin at Okaloosa/Santa Rosa County line and six 3/4
34	miles south of the Alabama State Line, thence Easterly
35	and Southeasterly on State Forest Road (Peaden Bridge
36	Road then John Riley Barnhill Road) to intersect with
37	Narrows Creek, thence Easterly along Narrows Creek to
38	intersect with State Highway 189, thence run North 3/4
39	mile along State Highway 189 to intersect with State
40	Forest Road (Shockley Springs Road) thence run Easterly
41	along State Forest Road (Shockley Springs Road) to
42	intersect Bear Branch, continue East along Bear Branch
43	to intersect Yellow River, thence Southerly along the
44	channel of the Yellow River to the North Section line
45	of Section 2, Township 3 North, Range 24 West, thence
46	run West along Section lines to the intersection of Old
47	River Road, thence run South along Old River Road to

101	(2) Any lands within a municipality included in the
102	boundaries of the district as described herein shall be excluded
103	from the district and its jurisdiction. If any area, tract, or
104	parcel of land within the boundaries of the district shall
105	hereafter become annexed to a municipality, such area, tract, or
106	parcel of land shall be excluded from the district effective the
107	next January 1 following such annexation by a municipality.
108	Nothing contained in this act shall preclude any municipality
109	from annexing lands to the territorial limits of the
110	municipality even if such land is included within the district.
111	(3) Should any part of the territory covered in this act
112	be held not to be included herein, then this act shall continue
113	in effect as to the balance of the territory.
114	Section 2. Section 1 of section 2 of chapter 2001-333,
115	Laws of Florida, is amended to read:

289	Any federal lands or lands located within the described
290	boundaries of the City of Crestview are excluded from the
291	district. If any portion of the district is annexed into a
292	municipality or becomes part of another fire district, the North
293	Okaloosa Fire District shall be entitled to receive all
294	revenues, including non-ad valorem assessments and impact fees
295	generated from that property in the calendar year of annexation,
296	i.e., January 1 through December 31.
297	Section 3. This act shall take effect upon becoming a law.
