  1                      A bill to be entitled

  2         An act relating to the East County Water

  3         Control District, Hendry and Lee Counties;

  4         amending ch. 2000-423, Laws of Florida;

  5         providing for the apportionment of maintenance

  6         taxes equitably to all equally benefited

  7         properties; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 3 of section 3 of chapter 2000-423,

12  Laws of Florida, is amended to read:

13         Section 3.  Maintenance assessments.--Maintenance

14  assessments as provided for under section 298.54, Florida

15  Statutes, shall be apportioned upon the basis of the net

16  assessments of benefits assessed as accruing from original

17  construction and any subsequent improvements, and shall be due

18  and collected pursuant to section 298.54, Florida Statutes,

19  chapter 197, Florida Statutes, and this act. Provided, nothing

20  herein shall prevent the Board of Supervisors from

21  apportioning maintenance taxes for the maintenance of the

22  district facilities equally to all benefited acres if the

23  Board of Supervisors determines that benefits are

24  substantially equal for benefited acreage throughout the

25  District. Said assessments shall be a lien until paid on the

26  property against which assessed and enforceable in like manner

27  as county taxes.

28         Section 2.  This act shall take effect upon becoming a

29  law.
