| 6 | acute care hospitals; amending s. 121.0515, F.S.; revising | ||
| 7 | criteria for membership in the Special Risk Class to | ||
| 8 | include certain members employed by certain public acute | ||
| 9 | care hospitals; providing a statement of important state | ||
| 10 | interest; providing an effective date. | ||

| 12 | Be It Enacted by the Legislature of the State of Florida: | ||
| 13 | |||
| 14 | Section 1. Paragraph (f) is added to subsection (15) of | ||
| 15 | section 121.021, Florida Statutes, to read: | ||
| 16 | 121.021 Definitions.--The following words and phrases as | ||
| 17 | used in this chapter have the respective meanings set forth | ||
| 18 | unless a different meaning is plainly required by the context: | ||
| 19 | (15) | ||
| 20 | (f) Effective July 1, 2003, "special risk member" includes | ||
| 21 | any member who is employed by a public acute care hospital which | ||
| 22 | serves as a trauma center and provides treatment to members of | ||
| 23 | the public with deadly or crippling infectious diseases, members | ||
| 24 | of the public who are accused or convicted of serious violent | ||
| 25 | crimes, members of the public who have been subjected to | ||
| 26 | hazardous materials or biological or chemical agents as a result | ||
| 27 | of terrorism or industrial accidents, or members of the public | ||
| 28 | with diseases the treatment of which requires interventions with | ||
| 29 | extremely toxic substances. | ||
| 30 | Section 2. Paragraph (h) is added to subsection (2) of | ||
| 31 | section 121.0515, Florida Statutes, to read: | ||
| 32 | 121.0515 Special risk membership.-- | ||
| 33 | (2) CRITERIA.--A member, to be designated as a special | ||
| 34 | risk member, must meet the following criteria: | ||
| 35 | (h) A member who is employed by a public acute care | ||
| 36 | hospital which serves as a trauma center and provides treatment | ||
| 37 | to members of the public with deadly or crippling infectious | ||
| 38 | diseases, members of the public who are accused or convicted of | ||
| 39 | serious violent crimes, members of the public who have been | ||
| 40 | subjected to hazardous materials or biological or chemical | ||
| 41 | agents as a result of terrorism or industrial accidents, or | ||
| 42 | members of the public with diseases the treatment of which | ||
| 43 | requires interventions with extremely toxic substances. | ||
| 44 | Section 3. The Legislature finds that in providing | ||
| 45 | treatment to members of the public with deadly or crippling | ||
| 46 | infectious diseases, members of the public who are accused or | ||
| 47 | convicted of serious violent crimes, members of the public who | ||
| 48 | have been subjected to hazardous materials or biological or | ||
| 49 | chemical agents as a result of terrorism or industrial | ||
| 50 | accidents, or members of the public with diseases the treatment | ||
| 51 | of which requires interventions with extremely toxic substances, | ||
| 52 | a member of the Florida Retirement System who is employed by a | ||
| 53 | public acute care hospital which serves as a trauma center, is | ||
| 54 | serving an important state interest and should be a member of | ||
| 55 | the Special Risk Class of the Florida Retirement System. | ||
| 56 | Section 4. This act shall take effect July 1, 2003. | ||
