1 A bill to be entitled
2          An act relating to the Department of Highway Safety and
3    Motor Vehicles; amending s. 322.27, F.S.; requiring law
4    enforcement agencies to notify the department of any
5    traffic fatality or the commission of an offense that
6    requires mandatory revocation of license upon conviction;
7    providing an effective date.

9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Subsection (1) of section 322.27, Florida
12    Statutes, is amended to read:
13          322.27 Authority of department to suspend or revoke
14    license.--
15          (1) Notwithstanding any provisions to the contrary in
16    chapter 120, the department is hereby authorized to suspend the
17    license of any person without preliminary hearing upon a showing
18    of its records or other sufficient evidence that the licensee:
19          (a) Has committed an offense for which mandatory
20    revocation of license is required upon conviction. A law
21    enforcement agency must provide information to the department
22    within 24 hours after any traffic fatality or the commission of
23    an offense for which mandatory revocation of license upon
24    conviction is required;
25          (b) Has been convicted of a violation of any traffic law
26    which resulted in a crash that caused the death or personal
27    injury of another or property damage in excess of $500;
28          (c) Is incompetent to drive a motor vehicle;
29          (d) Has permitted an unlawful or fraudulent use of such
30    license or has knowingly been a party to the obtaining of a
31    license by fraud or misrepresentation or to display, or
32    represent as one's own, any driver's license not issued him or
33    her. Provided, however, no provision of this section shall be
34    construed to include the provisions of s. 322.32(1);
35          (e) Has committed an offense in another state which if
36    committed in this state would be grounds for suspension or
37    revocation; or
38          (f) Has committed a second or subsequent violation of s.
39    316.172(1) within a 5-year period of any previous violation.
40          Section 2. This act shall take effect July 1, 2003.
