11 Senator Margolis moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 3, lines 4-11, delete those lines
15
16 and insert:
17 (4) A first violation of subsection (2) or subsection
18 (3) is punishable by a fine of $100. A second violation of
19 subsection (2) or subsection (3) is punishable by a fine of
20 $250. A third violation of subsection (2) or subsection (3) is
21 punishable by a fine of $500. A fourth or subsequent violation
22 of subsection (2) or subsection (3) is punishable by a fine as
23 determined by the Department of Agriculture, not to exceed
24 $1,000.00.
25 (5) The Department of Agriculture is authorized to
26 adopt rules to implement this section.
27 Section 2. This act shall take effect July 1, 2004.
