  1                      A bill to be entitled

  2         An act relating to postsecondary student fees;

  3         amending s. 1009.21, F.S.; classifying certain

  4         nonresident aliens as residents for tuition

  5         purposes; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  9         Section 1.  Paragraph (k) is added to subsection (10)

10  of section 1009.21, Florida Statutes, to read:

11         1009.21  Determination of resident status for tuition

12  purposes.--Students shall be classified as residents or

13  nonresidents for the purpose of assessing tuition in community

14  colleges and state universities.

15         (10)  The following persons shall be classified as

16  residents for tuition purposes:

17         (k)  Nonresident aliens who:

18         1.  Have resided in Florida for at least 2 years.

19         2.  Have attended a State Board of Education approved

20  Florida high school.

21         3.  Have graduated from a State Board of Education

22  approved Florida high school or have received a high school

23  equivalency diploma in Florida.

24         4.  Have filed an affidavit with a community college or

25  a state university which states that the student has applied

26  for legal immigrant status or will apply when the student

27  becomes eligible for such application.

28         Section 2.  This act shall take effect July 1, 2003.
