  1                      A bill to be entitled

  2         An act relating to dump trucks; creating s.

  3         319.121, F.S.; requiring that certain modified

  4         tractor trailers be titled and registered as

  5         dump trucks; requiring proof of a safety

  6         inspection by the Office of Motor Carrier

  7         Compliance within the Department of

  8         Transportation; requiring that the title and

  9         registration indicate that the tractor trailer

10         is a dump truck; providing penalties; providing

11         an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 319.121, Florida Statutes, is

16  created to read:

17         319.121  Rebuilt, modified, or retrofitted dump trucks;

18  title and registration requirements.--

19         (1)(a)  If a tractor trailer is rebuilt, modified, or

20  retrofitted into a dump truck, the rebuilt, modified, or

21  retrofitted tractor trailer must be titled and registered as a

22  dump truck. The rebuilt, modified, or retrofitted dump truck

23  may not be titled unless it is inspected by the Office of

24  Motor Carrier Compliance within the Department of

25  Transportation and certified as meeting federal and state

26  safety standards.

27         (b)  Upon applying for the title, the owner must

28  present proof to the department or local tax collector that

29  the vehicle has passed the safety inspection by the Office of

30  Motor Carrier Compliance. The vehicle title and registration

31  must denote that the vehicle is a dump truck.

 1         (2)  A person who registers or titles a tractor trailer

 2  by means of false or fraudulent representation made in any

 3  application for titling or registration, as provided in this

 4  section, commits a misdemeanor of the second degree,

 5  punishable as provided in s. 775.082 or s. 775.083.

 6         (3)  If an owner of a tractor trailer that is rebuilt,

 7  modified, or retrofitted into a dump truck fails to register

 8  the tractor trailer as a dump truck, the owner commits a

 9  misdemeanor of the first degree, punishable as provided in s.

10  775.082 or s. 775.083.

11         (4)  If a driver operates a tractor trailer that is

12  rebuilt, modified, or retrofitted into a dump truck while

13  knowing that the tractor trailer is not registered as a dump

14  truck, the driver commits a misdemeanor of the first degree,

15  punishable as provided in s. 775.082 or s. 775.083.

16         Section 2.  This act shall take effect October 1, 2003.

19                          SENATE SUMMARY

20    Requires a tractor trailer to be registered and titled as
      a dump truck if that tractor trailer is rebuilt,
21    modified, or retrofitted into a dump truck. Requires a
      safety inspection. Provides that it is a second-degree
22    misdemeanor to fraudulently register or title a tractor
      trailer. Provides that it is a first-degree misdemeanor
23    to fail to register a modified tractor trailer or to
      operate a modified tractor trailer while knowing that it
24    is not registered as a dump truck.
