1 A bill to be entitled
2          An act relating to limited-issue specialty license plates;
3    amending ss. 320.08056 and 320.089, F.S.; creating the
4    Firefighter license plate; providing for the distribution
5    of annual use fees received from the sale of such plates;
6    providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Paragraph (mm) is added to subsection (4) of
11    section 320.08056, Florida Statutes, to read:
12          320.08056 Specialty license plates.--
13          (4) The following license plate annual use fees shall be
14    collected for the appropriate specialty license plates:
15          (mm) Firefighter license plate, $25.
16          Section 2. Section 320.089, Florida Statutes, is amended
17    to read:
18          320.089 Limited-issue specialtyMembers of National Guard
19    and active United States Armed Forces reservists; former
20    prisoners of war; survivors of Pearl Harbor; Purple Heart medal
21    recipients; speciallicense plates; fee.--
22          (1) MEMBERS OF NATIONAL GUARD AND ACTIVE UNITED STATES
23    ARMED FORCES RESERVISTS; SURVIVORS OF PEARL HARBOR; PURPLE HEART
24    MEDAL RECIPIENTS.--
25          (a) Each owner or lessee of an automobile or truck for
26    private use or recreational vehicle as specified in s.
27    320.08(9)(c) or (d), which is not used for hire or commercial
28    use, who is a resident of the state and an active or retired
29    member of the Florida National Guard, a survivor of the attack
30    on Pearl Harbor, a recipient of the Purple Heart medal, or an
31    active member of any branch of the United States Armed Forces
32    Reserve shall, upon application to the department, accompanied
33    by proof of active membership or retired status in the Florida
34    National Guard, proof of membership in the Pearl Harbor
35    Survivors Association or proof of active military duty in Pearl
36    Harbor on December 7, 1941, proof of being a Purple Heart medal
37    recipient, or proof of active membership in any branch of the
38    Armed Forces Reserve, and upon payment of the license tax for
39    the vehicle as provided in s. 320.08, be issued a license plate
40    as provided by s. 320.06, upon which, in lieu of the serial
41    numbers prescribed by s. 320.06, shall be stamped the words
42    "National Guard," "Pearl Harbor Survivor," "Combat-wounded
43    veteran," or "U.S. Reserve," as appropriate, followed by the
44    serial number of the license plate. Additionally, the Purple
45    Heart plate may have the words "Purple Heart" stamped on the
46    plate and the likeness of the Purple Heart medal appearing on
47    the plate.
48          (b) Notwithstanding any other provision of law to the
49    contrary, beginning with fiscal year 2002-2003 and annually
50    thereafter, the first $100,000 in general revenue generated from
51    the sale of license plates issued under this section which are
52    stamped with the words "National Guard," "Pearl Harbor
53    Survivor," "Combat-wounded veteran," or "U.S. Reserve" shall be
54    deposited into the Grants and Donations Trust Fund, as described
55    in s. 296.38(2), to be used for the purposes established by law
56    for that trust fund.
57          (c) Notwithstanding any provisions of law to the contrary,
58    an applicant for a Pearl Harbor Survivor license plate or a
59    Purple Heart license plate who also qualifies for a disabled
60    veteran's license plate under s. 320.084 shall be issued the
61    appropriate special license plate without payment of the license
62    tax imposed by s. 320.08.
63          (2) FORMER PRISONERS OF WAR.--Each owner or lessee of an
64    automobile or truck for private use, truck weighing not more
65    than 7,999 pounds, or recreational vehicle as specified in s.
66    320.08(9)(c) or (d), which is not used for hire or commercial
67    use, who is a resident of the state and who is a former prisoner
68    of war, or their unremarried surviving spouse, shall, upon
69    application therefor to the department, be issued a license
70    plate as provided in s. 320.06, on which license plate are
71    stamped the words "Ex-POW" followed by the serial number. Each
72    application shall be accompanied by proof that the applicant
73    meets the qualifications specified in paragraph (a) or paragraph
74    (b).
75          (a) A citizen of the United States who served as a member
76    of the Armed Forces of the United States or the armed forces of
77    a nation allied with the United States who was held as a
78    prisoner of war at such time as the Armed Forces of the United
79    States were engaged in combat, or their unremarried surviving
80    spouse, may be issued the special license plate provided for in
81    this subsection without payment of the license tax imposed by s.
82    320.08.
83          (b) A person who was serving as a civilian with the
84    consent of the United States Government, or a person who was a
85    member of the Armed Forces of the United States who was not a
86    United States citizen and was held as a prisoner of war when the
87    Armed Forces of the United States were engaged in combat, or
88    their unremarried surviving spouse, may be issued the special
89    license plate provided for in this subsection upon payment of
90    the license tax imposed by s. 320.08.
91          (3) PURPLE HEART MEDAL RECIPIENTS SURVIVING SPOUSES.--Each
92    owner or lessee of an automobile or truck for private use, truck
93    weighing not more than 7,999 pounds, or recreational vehicle as
94    specified in s. 320.08(9)(c) or (d), which is not used for hire
95    or commercial use, who is a resident of this state and who is
96    the unremarried surviving spouse of a recipient of the Purple
97    Heart medal shall, upon application therefor to the department,
98    with the payment of the required fees, be issued a license plate
99    as provided in s. 320.06, on which license plate are stamped the
100    words "Purple Heart" and the likeness of the Purple Heart medal
101    followed by the serial number. Each application shall be
102    accompanied by proof that the applicant is the unremarried
103    surviving spouse of a recipient of the Purple Heart medal.
104          (4) FIREFIGHTERS.--Each owner or lessee of an automobile
105    or truck for private use or recreational vehicle as specified in
106    s. 320.08(9)(c) or (d), which is not used for hire or commercial
107    use, who is a resident of the state and an active or retired
108    firefighter, the spouse of such firefighter, or the unremarried
109    surviving spouse of a firefighter shall, upon application to the
110    department and upon payment of the applicable license taxes and
111    use fees, be issued a license plate as provided by s. 320.06.
112    Each application shall be accompanied by proof that the
113    applicant is an active or retired firefighter, the spouse of
114    such firefighter, or the unremarried surviving spouse of a
115    firefighter, including, but not limited to, a current
116    identification and badge or a letter from the firefighters'
117    association of which the firefighter is or was a member.
118          (a) Notwithstanding any other provision of law, the
119    department shall develop a Firefighter license plate as provided
120    in this subsection. Firefighter license plates must bear the
121    colors and design approved by the department. The word "Florida"
122    must appear at the top of the plate and the word "Firefighter"
123    must appear at the bottom of the plate.
124          (b) The proceeds of the annual use fee shall be
125    distributed equally to Shands Burn Center at the University of
126    Florida in Alachua County, Orlando Regional Medical Center Burn
127    Unit in Orange County, University of Miami-Jackson Memorial Burn
128    Center in Miami-Dade County, and Tampa General Hospital Regional
129    Burn Center in Hillsborough County. The funds shall be used
130    specifically for the burn center or unit at each of those health
131    care facilities.
132          Section 3. This act shall take effect July 1, 2003.
