1 A bill to be entitled
2 An act relating to adoption; providing a short
3 title; creating s. 63.0725, F.S.; providing for
4 the payment of certain fees to the adoptive
5 parents when a family member of the child is
6 awarded custody of the child from the adoptive
7 parents; providing that a portion of such fee
8 shall be awarded to the Department of Children
9 and Family Services; providing for the payment
10 of certain fees to the department; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Short title.--This act may be cited as the
16 "Thomas C. Kenaston, Jr., Adoption Reform Act."
17 Section 2. Section 63.0725, Florida Statutes, is
18 created to read:
19 63.0725 Adoption return; reimbursement.--
20 (1) When a family member of a child who has been
21 adopted seeks the return of the child from the adoptive
22 parents, and the court awards the child to the family member
23 rather than the adoptive parents, before the court may permit
24 the child to be returned to the family member, the adoptive
25 parents must be reimbursed for the support, care, and love
26 they have given to the child at the rate of $100 per day for
27 each day the child was in the care of the adoptive parents.
28 Of the fee of $100 per day, 50 percent of the fee shall be
29 awarded to the adoptive parents and 50 percent of the fee
30 shall be awarded to the Department of Children and Family
31 Services.

1 (2) In addition to the fees required in subsection
2 (1), the family member seeking the return of the child from
3 the adoptive parents shall also be required to reimburse fully
4 the Department of Children and Family Services for any
5 expenditures made by the department on behalf of the child.
6 Section 3. This act shall take effect October 1, 2003.

9 SENATE SUMMARY

Creates the "Thomas C. Kenaston, Jr., Adoption Reform
11 Act," to provide that when a family member seeks the
return of a child from the child's adoptive parents, and
12 is awarded the child, before the court may turn
possession of the child over to the family member, the
13 adoptive parents shall be reimbursed for the support,
care, and love they have given the child at the rate of
14 $100 per day for each day the child has been in the care
of the adoptive parents. Provides that 50 percent of the
15 $100 fee shall be awarded to the Department of Children
and Family Services. Also requires payment to the
16 department for expenditures made by the department on
behalf of the child.
