12          Representative Gannon offered the following:

14          Amendment (with title amendment)
15          Remove line(s) 46-74, and insert:
16          aggressor, or provoker of the incident.
17          (g) The defendant acted under extreme duress or under the
18    domination of another person.
19          (h) Before the identity of the defendant was determined,
20    the victim was substantially compensated.
21          (i) The defendant cooperated with the state to resolve the
22    current offense or any other offense.
23          (j) The offense was committed in an unsophisticated manner
24    and was an isolated incident for which the defendant has shown
25    remorse, except as provided in subsection (4).
26          (k) At the time of the offense the defendant was too young
27    to appreciate the consequences of the offense.
28          (l) The defendant is to be sentenced as a youthful
29    offender.
30          (3) The defendant's substance abuse or addiction,
31    including intoxication at the time of the offense, is not a
32    mitigating factor under subsection (2) and does not, under any
33    circumstances, justify a downward departure from the permissible
34    sentencing range.
35          (4) The fact that the defendant committed the crime in an
