1 A bill to be entitled
2 An act relating to Florida-based film industry;
3 providing for a preference for Florida-based
4 bidders in state contracting for commercial
5 film industry work when certain conditions are
6 met; prescribing requirements for successful
7 bidders with respect to use of subcontractors
8 and talent; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. This act may be cited as "The Barry Plans
13 Florida Film Industry Equity Act."
14 Section 2. State contracts with Florida-based
15 commercial film enterprises; preferences.--
16 (1) Whenever competitive bids related to commercial
17 film industry work are requested by the state and two or more
18 such bids are received, and whenever all things stated in such
19 requests and received bids are equal with respect to quality
20 and service and are within 2 percent with respect to price,
21 commercial film enterprises based in this state shall be given
22 preference.
23 (2) With regard to such bids, successful bidders must
24 use Florida-based talent or subcontractors when available.
25 Pursuant to part I of chapter 447, Florida Statutes, workers
26 have the right to self-determination; therefore, no contractor
27 or individual talent may be discriminated against as a result
28 of any professional affiliation or lack of professional
29 affiliation.
30 Section 3. This act shall take effect July 1, 2003.
