13          An act relating to community care for the elderly;
14    amending s. 430.205, F.S.; providing guidelines for
15    determining the priority of recipients of services;
16    providing an effective date.
17         
18          Be It Enacted by the Legislature of the State of Florida:
19         
20          Section 1. Subsection (5) of section 430.205, Florida
21    Statutes, is amended to read:
22          430.205 Community care service system.--
23          (5) Any person who has been classified as a functionally
24    impaired elderly person is eligible to receive community-care-
25    for-the-elderly core services.
26          (a)Those elderly persons who are determined by protective
27    investigations to be vulnerable adults in need of services,
28    pursuant to s. 415.104(3)(b), or to be victims of abuse,
29    neglect, or exploitation who are in need of immediate services
30    to prevent further harm and are referred by the adult protective
31    services program, shall be given primary consideration for
32    receiving community-care-for-the-elderly services. As used in
33    this paragraphsubsection, "primary consideration" means that an
34    assessment and services must commence within 72 hours after
35    referral to the department or as established in accordance with
36    department contracts by local protocols developed between
37    department service providers and the adult protective services
38    program.
39          (b) The department shall determine an order of
40    prioritization for all other functionally impaired elderly
41    persons seeking community-care-for-the-elderly services that is
42    based upon the potential recipient’s frailty level and
43    likelihood of institutional placement without such services.
44    After determining such frailty level and likelihood of
45    institutional placement, should the list of potential recipients
46    require further prioritization, another factor that must be
47    considered is the potential recipient’s ability to pay for such
48    services. Those who are less able to pay for such services must
49    receive higher priority than those who are better able to pay
50    for such services. A potential recipient’s ability to pay may be
51    determined by the department based on the potential recipient’s
52    self-declared statement of income and expenses.
53          Section 2. This act shall take effect July 1, 2003.
