12          Representative Bucher offered the following:

14          Amendment (with title amendment)
15          Remove line(s) 1149, and insert:
16          of the number of claimants or defendants involved in the action;
17    however, this section shall not limit noneconomic damages
18    recoverable from any person who has been found to have committed
19    two or more incidents of medical malpractice. For purposes of
20    this section:
21          (1) "Medical malpractice" means both the failure to
22    practice medicine in this state with the level of care, skill,
23    and treatment recognized in general law related to health care
24    providers' licensure, and any similar wrongful act, neglect, or
25    default in any other state or country which, if committed in
26    this state, would be considered medical malpractice.
27          (2) "Found to have committed" means that the malpractice
28    has been found in a final judgment of a court of law, final
29    administrative agency decision, or decision of binding
30    arbitration or similar process which is entered or enforceable
31    in a court of law.
