for annual carryforward of unused funds; providing for |

future review and termination or re-creation of the trust |

fund; providing a contingent effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

Section 1. Section 20.2101, Florida Statutes, is created |
13
|
to read: |

|
20.2101 State Law Enforcement Officer Recruitment and |
15
|
Retention Trust Fund.--
|

|
(1) There is created the State Law Enforcement Officer |
17
|
Recruitment and Retention Trust Fund within the Department of |
18
|
Revenue. Funds shall be credited to the trust fund as provided |
19
|
by law to be used for the purpose of recruiting and retaining |
20
|
law enforcement officers in the state.
|

|
(2) Notwithstanding the provisions of s. 216.301 and |
22
|
pursuant to s. 216.351, any balance in the trust fund at the end |
23
|
of any fiscal year shall remain in the trust fund at the end of |
24
|
the year and shall be available for carrying out the purposes of |
25
|
the trust fund.
|

(3) Pursuant to the provisions of s. 19(f)(2), Art. III of |
27
|
the State Constitution, the trust fund shall, unless terminated |
28
|
sooner, be terminated on July 1, 2007. Prior to its scheduled |
29
|
termination, the trust fund shall be reviewed as provided in s. |
30
|
215.3206(1) and (2).

Section 2. This act shall take effect July 1, 2003, if |
32
|
House Bill 859 or similar legislation is adopted in the same |
33
|
legislative session or an extension thereof and becomes law. |
