11 A bill to be entitled
12          An act relating to trust funds; creating the Rape Crisis
13    Program Trust Fund within the Department of Health;
14    providing for the use of funds and the source of funds;
15    requiring the Department of Health to adopt rules for
16    distributing moneys in the trust fund; providing for
17    review and termination or re-creation of the trust fund;
18    providing a contingent effective date.

20          Be It Enacted by the Legislature of the State of Florida:
21         
22          Section 1. Rape Crisis Program Trust Fund.--
23          (1) The Rape Crisis Program Trust Fund is created within
24    the Department of Health for the purpose of providing funds for
25    rape crisis centers in this state. Trust fund moneys shall be
26    used exclusively for the purpose of providing services for
27    victims of sexual assault. Funds credited to the trust fund
28    consist of those funds collected as an additional court
29    assessment in each case in which a defendant pleads guilty or
30    nolo contendere to, or is found guilty of, regardless of
31    adjudication, a violation of s. 784.011, s. 784.021, s. 784.03,
32    s. 784.041, s. 784.045, s. 784.048, s. 784.07, s. 784.08, s.
33    784.081, s. 784.082, s. 784.083, s. 784.085, or s. 794.011,
34    Florida Statutes.
35          (2) The Department of Health shall establish by rule
36    criteria for distributing moneys from the trust fund to rape
37    crisis centers.
38          (3) In accordance with s. 19(f)(2), Art. III of the State
39    Constitution, the Rape Crisis Program Trust Fund shall be
40    terminated on July 1, 2007, unless terminated sooner. Before its
41    scheduled termination, the trust fund shall be reviewed as
42    provided in s. 215.3206(1) and (2), Florida Statutes.
43          Section 2. This act shall take effect July 1, 2003, if HB
44    ____ or similar legislation creating the Sexual Assault Victims'
45    Access to Services Act is adopted in the same legislative
46    session, or an extension thereof, and becomes law.
