1 A bill to be entitled
2 An act relating to student financial
3 assistance; prohibiting state funds from being
4 used to provide financial assistance to certain
5 postsecondary education students who are
6 citizens of specified countries; requiring the
7 amount of funds used for such purpose in fiscal
8 year 2001-2002 to be allocated annually to the
9 Florida Bright Futures Scholarship Program;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Notwithstanding any other provision of law
15 to the contrary, no funds from general revenue, the lottery,
16 or financial aid fee revenues shall be used to provide student
17 financial assistance in the form of scholarships, fellowships,
18 grants, loans, tuition or fee waivers, or other financial
19 assistance to any nonresident alien student who is enrolled in
20 a Florida public postsecondary educational institution and who
21 is a citizen of any country that is identified by the United
22 States Department of State as terrorist or supporting
23 terrorism. A student's country of citizenship shall be
24 determined at the time of a student's enrollment. A
25 nonresident alien student who has been determined ineligible
26 pursuant to the provisions of this section shall remain
27 ineligible for such assistance while enrolled in a Florida
28 public postsecondary educational institution. However, if a
29 student's country of citizenship is removed from the United
30 States Department of State list of identified countries, such

1 student shall become eligible for student financial assistance
2 pursuant to the provisions of this section.
3 Section 2. The amount of state-funded student
4 financial assistance provided by Florida public postsecondary
5 educational institutions to students specified in section 1 of
6 this act during fiscal year 2001-2002 shall be allocated
7 annually for fiscal year 2003-2004 and each subsequent fiscal
8 year to the Florida Bright Futures Scholarship Program. Such
9 funds shall not be used to replace current-level funding for
10 the Florida Bright Futures Scholarship Program, but shall be
11 supplemental funds.
12 Section 3. This act shall take effect July 1, 2003.
