1 A bill to be entitled
2 An act relating to public records; providing an
3 exemption from public-records requirements for
4 the security plans for sources of potable water
5 and potable water treatment facilities owned or
6 operated by or under contract to a regional
7 water supply authority, a county, a special
8 district, or a municipality; providing for
9 future legislative review and repeal; providing
10 a statement of public necessity; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Security plans for sources of potable water
16 and potable water treatment facilities owned or operated by or
17 under contract to a regional water supply authority, a county,
18 a special district, or a municipality are exempt from the
19 requirements of section 119.07(1), Florida Statutes, and
20 Section 24(a), Article I of the State Constitution. Materials
21 that depict critical operating and distribution facilities are
22 also exempt if the agency determines that the materials
23 contain information that is not generally known and that could
24 jeopardize public health, safety, and welfare. This includes,
25 but is not limited to, information on chemical purchases and
26 storage, power generation systems, facility operations
27 manuals, design information, security systems, plans, and
28 maps. This section is subject to the Open Government Sunset
29 Review Act of 1995 in accordance with section 119.15, Florida
30 Statutes, and shall stand repealed on October 2, 2008, unless

1 reviewed and saved from repeal through reenactment by the
2 Legislature.
3 Section 2. The Legislature finds that the exemptions
4 from public records requirements provided by this act are
5 necessary to ensure the security of potable water sources and
6 treatment facilities that are critical to the public health,
7 safety, and welfare and that are potential targets for
8 terrorist activities.
9 Section 3. This act shall take effect October 1, 2003.

12 SENATE SUMMARY
13 Provides that the security plans for sources of potable
water and potable water treatment facilities owned or
14 operated by or under contract to a regional water supply
authority, a county, a special district, or a
15 municipality are exempt from disclosure under the
public-records law. Provides for future legislative
16 review and repeal under the Open Government Sunset Review
Act of 1995.
