2 An act relating to publication information;
3 creating s. 283.551, F.S.; prohibiting
4 government agencies from mailing general
5 unsolicited reports to any person in the state;
6 providing exceptions; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Section 283.551, Florida Statutes, is
12 created to read:
13 283.551 Unsolicited distribution of general reports by
14 mail prohibited; exceptions.--
15 (1)(a) Unless otherwise authorized by law, no agency
16 shall mail an unsolicited copy of an annual report or periodic
17 newsletter by United States Postal Service, or other method of
18 delivery, except e-mail, to any person, including an elected
19 or appointed officer or governmental employee, except for any
20 state elected or appointed state officer or state legislative
21 employee. Nothing in this section applies to regulatory
22 newsletters provided to affected persons or to reports or
23 newsletters relating to the prevention or treatment of disease
24 or injury.
25 (b) Unsolicited agency e-mails authorized by this
26 section must contain a provision that allows the recipient to
27 be removed from future unsolicited agency e-mails upon his or
28 her e-mail request.
29 (2) An agency shall send to any person, including an
30 elected or appointed officer or governmental employee, or to
31 any state or local governmental entity, a copy of a general

1 report or newsletter by United States Postal Service, by
2 e-mail, or by other method of delivery:
3 (a) Upon a specific request for a particular report or
4 newsletter; or
5 (b) Upon a general request to receive all agency
6 reports or newsletters, which request must be renewed as
7 provided in s. 283.55.
8 (3) A request for a report or newsletter must state
9 whether the recipient wishes to receive the document by
10 regular mail, by e-mail, or by other method of delivery.
11 (4) An agency may post any general report on its
12 Internet website.
13 Section 2. This act shall take effect upon becoming a
14 law.
