  1                      A bill to be entitled

  2         An act relating to public contracts; creating

  3         s. 287.0576, F.S.; specifying certain unlawful

  4         activities in certain public project bid

  5         solicitations; providing a penalty; providing

  6         an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Section 287.0576, Florida Statutes, is

11  created to read:

12         287.0576  Bid rigging prohibition; penalty.--

13         (1)  It is unlawful, whenever soliciting a bid for a

14  procurement contract under this chapter or a contract subject

15  to the requirements of s. 255.05:

16         (a)  To disclose information about the project to any

17  person who may submit a bid on the project unless the same

18  information is disclosed to all persons who may submit a bid

19  on the project.

20         (b)  For two or more persons to enter into an agreement

21  in which one or more such persons under the agreement agrees

22  not to bid on the project or submit a bid higher or lower than

23  any other person under the agreement.

24         (2)  Any person who violates any provision of

25  subsection (1) commits a felony of the third degree,

26  punishable as provided in s. 775.082, s. 775.083, or s.

27  775.084.

28         Section 2.  This act shall take effect upon becoming a

29  law.
