Section 40. Subsections (8) and (9) of section 322.20, |
|

Florida Statutes, are amended to read: |
|

|
322.20 Records of the department; fees; destruction of |
|
20
|
records.-- |
|

|
(8) Except as provided in s. 119.07(6)(3), the department |
|
22
|
may release records as provided in this section when a licensee |
|
23
|
has provided express written consent prior to the release of the |
|
24
|
licensee's personal information in such records as required by |
|
25
|
federal law. |
|
26
|
(9) Except as provided in subsection (8),the department |
|
27
|
may, upon application, furnish to any person, from the records |
|
28
|
of the Division of Driver Licenses, a list of the names, |
|
29
|
addresses, and birth dates of the licensed drivers of the entire |
|
30
|
state or any portion thereof by age group. In addition, the |
|
31
|
department may furnish to the courts, for the purpose of |
|
32
|
establishing jury selection lists, the names, addresses, and |
|
33
|
birth dates of the persons of the entire state or any portion |
|
34
|
thereof by age group having identification cards issued by the |
|
35
|
department. Each person who requests such information shall pay |
|
36
|
a fee, set by the department, of 1 cent per name listed, except |
|
37
|
that the department shall furnish such information without |
|
38
|
charge to the courts for the purpose of jury selection or to any |
|
39
|
state agency or to any state attorney, sheriff, or chief of |
|
40
|
police. Such court, state agency, state attorney, or law |
|
41
|
enforcement agency may not sell, give away, or allow the copying |
|
42
|
of such information. Noncompliance with this prohibition shall |
|
43
|
authorize the department to charge the noncomplying court, state |
|
44
|
agency, state attorney, or law enforcement agency the |
|
45
|
appropriate fee for any subsequent lists requested. The |
|
46
|
department may adopt rules necessary to implement this |
|
47
|
subsection. |
