Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

|
Section 1. Section 119.071, Florida Statutes, is amended |
|
14
|
to read: |
|
15
|
119.071 General exemptions from inspection or copying of |
|
16
|
public records.--A security system plan or portion thereof for: |
|
17
|
(1) Any property owned by or leased to the state or any of |
|
18
|
its political subdivisions; or |
|
19
|
(2) Any privately owned or leased property |
|
20
|
|
|
21
|
which plan or portion thereof is held byin the possession of |
|
22
|
any agency, as defined in s. 119.011, is confidential and exempt |
|
23
|
from the provisions of s. 119.07(1) and s. 24(a), Art. I of the |
|
24
|
State Constitution. As used in this section, the term a |
|
25
|
"security system plan" includes all records, information, |
|
26
|
photographs, audio and visual presentations, schematic diagrams, |
|
27
|
surveys, recommendations, or consultations or portions thereof |
|
28
|
relating directly to the physical security of the facility or |
|
29
|
revealing security systems; threat assessments conducted by any |
|
30
|
agency as defined in s. 119.011 or any private entity; threat |
|
31
|
response plans; emergency evacuation plans; sheltering |
|
32
|
arrangements; or manuals for security personnel, emergency |
|
33
|
equipment, or security training. This exemption is remedial in |
|
34
|
nature and it is the intent of the Legislature that this |
|
35
|
exemption be applied to security system plans heldreceivedby |
|
36
|
an agency before, on, or after the effective date of this |
|
37
|
section. Information made confidential and exempt by this |
|
38
|
section may be disclosed by the custodial agency to the property |
|
39
|
owner or leaseholder who requests the security system plan or to |
|
40
|
another state or federal agency to prevent, detect, guard |
|
41
|
against, respond to, investigate, or manage the consequences of |
|
42
|
any attempted or actual act of terrorism, or to prosecute those |
|
43
|
persons who are responsible for such attempts or acts, and the |
|
44
|
confidential and exempt status of such information shall be |
|
45
|
retained while in the possession of the receiving agency. This |
|
46
|
section is subject to the Open Government Sunset Review Act of |
|
47
|
1995, in accordance with s. 119.15, and shall stand repealed on |
|
48
|
October 2, 2006, unless reviewed and saved from repeal through |
|
49
|
reenactment by the Legislature. |
|
50
|
Section 2. Section 281.301, Florida Statutes, is repealed. |
|
51
|
Section 3. This act shall take effect upon becoming a law. |
