  1                      A bill to be entitled

  2         An act relating to the Emergency Planning and

  3         Community Right-to-Know Act; amending s.

  4         252.85, F.S.; providing a fee for all, rather

  5         than just certain, reports or filings required

  6         by section 313 of the Emergency Planning and

  7         Community Right-to-Know Act; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (3) of section 252.85, Florida

13  Statutes, is amended to read:

14         252.85  Fees.--

15         (3)  Any owner or operator of a facility that is

16  required to submit a report or filing under s. 313 of EPCRA

17  shall pay an annual reporting fee not to exceed $150 for those

18  s. 313 EPCRA listed substances in effect on January 1, 1998.

19  The department shall establish by rule the date by which the

20  fee is to be paid, as well as a formula for or method of

21  determining the applicable fee under this subsection.

22         Section 2.  This act shall take effect July 1, 2003.
