15          Between line(s) 3040 and 3041, insert:
16          Section 103. Subsections (5) through (13) of section
17    1005.31, Florida Statutes, are renumbered as subsections (6)
18    through (14), respectively, subsection (4) of said section is
19    amended, and a new subsection (5) is added to said section, to
20    read:
21          1005.31 Licensure of institutions.--
22          (4) Approved-applicant status shall be extended to all
23    institutions that have submitted a complete application, as
24    defined in rule, for provisional licensure and paid all
25    attendant fees. An incomplete application shall expire 1 year
26    after initial filing.In granting approved-applicant status, the
27    commission shall provide to commission staff and the institution
28    a list of specific omissions or deficiencies.Institutions
29    granted approved-applicant status may not advertise, offer
30    programs of study, collect tuition or fees, or engage in any
31    other activities not specifically approved by the commission. If
32    the commission, or the commission staff if specifically directed
33    by the commission, determines that the omissions or deficiencies
34    have been provided for or corrected, the institution may be
35    awarded a provisional license.
36          (5) The commission shall ensure that applicants for
37    licensure meet the standards as defined in rule through an
38    investigative process. When the investigative process is not
39    completed within the time set out in s. 120.60(1) and the
40    commission has reason to believe that the applicant does not
41    meet the criteria, the commission or commission staff may issue
42    a 90-day licensure delay which shall be in writing and
43    sufficient to notify the applicant of the reason for the delay.
44    The provisions of this subsection shall control over any
45    conflicting provisions of s. 120.60(1).
46          Section 104. Subsection (7) of section 1005.32, Florida
47    Statutes, is amended to read:
48          1005.32 Licensure by means of accreditation.--
49          (7) A license by means of accreditation may be denied,
50    placed on probation, or revoked for repeated failure to comply
51    with the requirements of this section, or for violation of any
52    provision of this chapter pertaining to discipline or violation
53    of any rules promulgated pursuant to this chapter pertaining to
54    discipline. The commission shall adopt rules for these actions.
55    Revocation or denial of a license by means of accreditation
56    requires that the institution immediately obtain a provisional
57    an annuallicense.
58          Section 105. Subsections (5) through (8) of section
59    1005.38, Florida Statutes, are renumbered as subsections (6)
60    through (9), respectively, and a new subsection (5) is added to
61    said section to read:
62          1005.38 Actions against a licensee and other penalties.--
63          (5) The commission may refuse to issue an initial license
64    to any applicant who is under investigation or prosecution in
65    any jurisdiction for an action that would constitute a violation
66    of this chapter or the professional practice acts administered
67    by the commission, until such time as the investigation or
68    prosecution is complete, and the time period in which the
69    licensure application must be granted or denied shall be tolled
70    until 15 days after the receipt of the final results of the
71    investigation or prosecution.
72          Section 106. Paragraph (b) of subsection (1) of section
73    1009.531, Florida Statutes, is amended to read:
74          1009.531 Florida Bright Futures Scholarship Program;
75    student eligibility requirements for initial awards.--
76          (1) To be eligible for an initial award from any of the
77    three types of scholarships under the Florida Bright Futures
78    Scholarship Program, a student must:
79          (b) Earn a standard Florida high school diploma or its
80    equivalent as described in s. 1003.43 or s. 1003.4351003.45
81    unless:
82          1. The student is enrolled full time in the early
83    admission program of an eligible postsecondary education
84    institution or completes a home education program according to
85    s. 1002.41; or
86          2. The student earns a high school diploma from a non-
87    Florida school while living with a parent or guardian who is on
88    military or public service assignment away from Florida.
