16 and insert:
17 (3) No contract or policy of insurance issued by a
18 carrier under this chapter shall expire or be canceled until
19 at least 30 days have elapsed after a notice of cancellation
20 or nonrenewal has been sent to the department and to the
21 employer in accordance with the provisions of s. 440.185(7).
22 For cancellation due to nonpayment of premium, the insurer
23 shall give written notification to the employer at least 10
24 days prior to the effective date of the cancellation. However,
25 when duplicate or dual coverage exists by reason of two
26 different carriers having issued policies of insurance to the
27 same employer securing the same liability, it shall be
28 presumed that only that policy with the later effective date
29 shall be in force and that the earlier policy terminated upon
30 the effective date of the latter. In the event that both
31 policies carry the same effective date, one of the policies

1 may be canceled instanter upon filing a notice of cancellation
2 or nonrenewal with the department and serving a copy thereof
3 upon the employer in such manner as the department prescribes
4 by rule. The department may by rule prescribe the content of
5 the notice of retroactive cancellation and specify the time,
6 place, and manner in which the notice of cancellation is to be
7 served. A carrier shall file with the department, at least 30
8 days prior to the effective date of cancellation or nonrenewal
9 of the policy, a notice of such cancellation or nonrenewal
10 and, at least 10 days prior to the effective date of
11 cancellation for nonpayment of premium, a notice of such
12 cancellation in a format prescribed by department rule.
