  1                      A bill to be entitled

  2         An act relating to municipal parking facility

  3         space surcharges; creating s. 212.035, F.S.;

  4         authorizing certain municipalities to impose

  5         and collect a surcharge on certain parking

  6         facility space sale, lease, or rental charges;

  7         requiring referendum approval; providing for a

  8         maximum surcharge rate; specifying uses and

  9         limits of surcharge proceeds; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 212.035, Florida Statutes, is

15  created to read:

16         212.035  Surcharge on municipal facility parking

17  fees.--

18         (1)  The governing authority of any municipality with a

19  resident population of 200,000 or more, more than 20 percent

20  of the real property of which is exempt from ad valorem taxes,

21  and which is located in a county with a population of more

22  than 500,000 may impose and collect, subject to referendum

23  approval by voters in the municipality, a discretionary

24  per-vehicle surcharge of up to 15 percent of the amount

25  charged for the sale, lease, or rental of space at parking

26  facilities within the municipality which are open for use to

27  the general public.

28         (2)  A municipal governing authority that imposes the

29  surcharge authorized by this subsection may use the proceeds

30  of such surcharge for the following purposes only:

  1         (a)  No less than 60 percent and no more than 80

  2  percent of surcharge proceeds shall be used to reduce the

  3  municipality's ad valorem tax millage or to reduce or

  4  eliminate non-ad valorem assessments.

  5         (b)  Not more than 40 percent and not less than 20

  6  percent of surcharge proceeds shall be used to improve

  7  transportation, including, but not limited to, street,

  8  sidewalk, roadway, landscape, transit, and streetscape

  9  beautification improvements.

10         Section 2.  This act shall take effect upon becoming a

11  law.
