creation of the trust fund; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. Alcohol, Drug Abuse, and Mental Health Trust |
12
|
Fund within the Department of Corrections.--
|

|
(1) There is created the Alcohol, Drug Abuse, and Mental |
14
|
Health Trust Fund within the Department of Corrections for the |
15
|
purpose of providing substance abuse treatment services to |
16
|
offenders. Funds shall be credited to the trust fund from |
17
|
federal substance abuse block grants. |

|
(2) Notwithstanding the provisions of s. 216.301, Florida |
19
|
Statutes, and pursuant to s. 216.351, Florida Statutes, any |
20
|
balance in the trust fund at the end of any fiscal year shall |
21
|
remain in the trust fund at the end of the year and shall be |
22
|
available for carrying out the purposes of the trust fund.
|

(3) Pursuant to the provisions of s. 19(f)(2), Art. III of |
24
|
the State Constitution, the trust fund shall, unless terminated |
25
|
sooner, be terminated on July 1, 2007. Prior to its scheduled |
26
|
termination, the trust fund shall be reviewed as provided in s. |
27
|
215.3206, Florida Statutes.

Section 2. This act shall take effect July 1, 2003. |
