| 2 | An act relating to trust funds; creating the Alcohol, Drug | ||

| 5 | purposes; providing for annual carryforward of unused | ||
| 6 | funds; providing for future review and termination or re- | ||
| 7 | creation of the trust fund; providing an effective date. | ||

| 9 | Be It Enacted by the Legislature of the State of Florida: | ||
| 10 | |||
| 11 | Section 1. Alcohol, Drug Abuse, and Mental Health Trust | ||
| 12 | Fund within the Department of Corrections.-- | ||
| 13 | (1) There is created the Alcohol, Drug Abuse, and Mental | ||
| 14 | Health Trust Fund within the Department of Corrections for the | ||
| 15 | purpose of providing substance abuse treatment services to | ||
| 16 | offenders. Funds shall be credited to the trust fund from | ||
| 17 | federal substance abuse block grants. | ||
| 18 | (2) Notwithstanding the provisions of s. 216.301, Florida | ||
| 19 | Statutes, and pursuant to s. 216.351, Florida Statutes, any | ||
| 20 | balance in the trust fund at the end of any fiscal year shall | ||
| 21 | remain in the trust fund at the end of the year and shall be | ||
| 22 | available for carrying out the purposes of the trust fund. | ||
| 23 | (3) Pursuant to the provisions of s. 19(f)(2), Art. III of | ||
| 24 | the State Constitution, the trust fund shall, unless terminated | ||
| 25 | sooner, be terminated on July 1, 2007. Prior to its scheduled | ||
| 26 | termination, the trust fund shall be reviewed as provided in s. | ||
| 27 | 215.3206, Florida Statutes. | ||
| 28 | Section 2. This act shall take effect July 1, 2003. | ||
