  1                      A bill to be entitled

  2         An act relating to school personnel; amending

  3         s. 1002.33, F.S.; requiring charter school

  4         personnel to be subject to state and federal

  5         rules and regulations that govern public school

  6         personnel; creating s. 1012.47, F.S.; requiring

  7         certain personnel in an alternative school that

  8         operates under contract with a district school

  9         system to file a set of fingerprints; requiring

10         personnel to be subject to state and federal

11         rules and regulations; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (a) of subsection (12) of section

17  1002.33, Florida Statutes, is amended to read:

18         1002.33  Charter schools.--

19         (12)  EMPLOYEES OF CHARTER SCHOOLS.--

20         (a)  A charter school shall select its own employees. A

21  charter school may contract with its sponsor for the services

22  of personnel employed by the sponsor. Charter school personnel

23  shall be subject to state and federal rules and regulations

24  that govern public school personnel.

25         Section 2.  Section 1012.47, Florida Statutes, is

26  created to read:

27         1012.47  Employment of alternative school

28  personnel.--All instructional and noninstructional personnel

29  who are hired to fill positions requiring direct contact with

30  students in an alternative school that operates under contract

31  with a district school system shall, upon employment and

 1  according to conditions of the contract, file a complete set

 2  of fingerprints as required in s. 1012.32. Such personnel

 3  shall be subject to state and federal rules and regulations

 4  that govern public school personnel.

 5         Section 3.  This act shall take effect July 1, 2003.
