14 On page 2, lines 21 through 26, delete those lines

16 and insert:
17 (c) The Miami-Dade County School Board is authorized
18 to accept applications from educational facilities benefit
19 districts or community development districts to establish a
20 pilot program to convert 5 feeder systems of public schools to
21 conversion charter-school-feeder-systems. Applications for
22 four of the conversion charter-school-feeder-systems must be
23 from educational facilities benefit districts or community
24 development districts located within municipal service areas
25 with a population of 75,000 or more as reported on the most
26 recent United States Census and one application must be from
27 an educational facilities benefit district or community
28 development district located in the unincorporated municipal
29 service area. Not more than one educational facilities
30 benefit district or community development district within a
31 municipality may apply for a conversion

1 charter-school-feeder-system. Any application for a conversion
2 charter-school-feeder-system must target poorly performing
3 feeder systems that are performing below state average on
4 state administered FCAT.
5 1. A conversion charter-school-feeder-system is
6 defined as one high school and the middle schools and
7 elementary schools where more than one-half of the students
8 are zoned to attend that high school and must include at least
9 one high school, one middle school, and one elementary school.
10 2. To participate in the pilot program, all schools
11 included in the conversion charter-school-feeder-system must
12 be located within the boundaries of the educational facilities
13 benefit district or community development district applying to
14 participate in the conversion pilot program.
15 3. Decisions of the school district regarding the
16 establishment of a conversion charter-school-feeder-system may
17 be appealed to the State Board of Education.
18 4. Operational funding for students attending charter
19 schools in a conversion charter-school-feeder-system shall be
20 provided at the same full time equivalent (FTE) student rate
21 as the student generates for the district with no
22 administrative hold back for district operations. Should the
23 educational facilities benefit district or community
24 development district provide operational funding for the
25 conversion charter-school-feeder-system, the district's
26 contribution per FTE shall be reduced on a dollar for dollar
27 basis to maintain equal funding per FTE throughout the
28 district.
29 5. Capital outlay funding for a conversion
30 charter-school-feeder-system shall be addressed in the charter
31 agreement with the school board. The charter may provide for

1 the district to continue to be responsible for the
2 maintenance, repair, renovation, and remodeling of the
3 facility or may provide a per student amount to the conversion
4 charter-school-feeder-system equal to the district's average
5 per student capital outlay funding amount. Should the
6 educational facilities benefit district or community
7 development district provide capital outlay funding for the
8 conversion charter-school-feeder-system, the district's
9 contribution per FTE shall be reduced on a dollar for dollar
10 basis to maintain equal funding per FTE throughout the
11 district.
12 6. Should the educational facilities benefit district
13 or community development district decide that a new school
14 facility must be constructed the district school board shall
15 provide capital outlay funding for new construction in an
16 amount that is equal to the district-wide average amount per
17 FTE student generated from 2 mills of nonvoted discretionary
18 capital outlay authorized in s. 1011.71(2). These funds may
19 not be pledged for debt service or financial obligations
20 entered into by the educational facilities benefit district or
21 community development district.
22 7. The purpose of the pilot program is to produce
23 significant improvements in student achievement and school
24 management including administrative efficiency, to encourage
25 and measure the use of innovative learning methods, and to
26 make the school the unit of improvement.
27 8. The approved conversion
28 charter-school-feeder-system application shall be the basis
29 for evaluation of the pilot program.
