13          Amendment
14          Remove line(s) 39-76, and insert:
15          Section . Subsections (13) and (14) are added to section
16    318.21, Florida Statutes, to read:
17          318.21 Disposition of civil penalties by county
18    courts.--All civil penalties received by a county court pursuant
19    to the provisions of this chapter shall be distributed and paid
20    monthly as follows:
21          (13)(a)1. For fiscal year 2003-2004, the first $1 million
22    of all additional fines and surcharges collected pursuant to s.
23    318.1225 and s. 322.287 shall be distributed to MADD Florida.
24    Contingent upon the enactment of legislation during the 2003
25    Regular Session of the Legislature requiring a study by the
26    department of the effects of aging on driving ability and the
27    creation of an advisory council for that purpose, the next $1
28    million shall be distributed to the department to fund the study
29    and the creation and operation of the advisory council. The
30    remaining funds resulting from the additional fines and
31    surcharges shall be distributed to the General Revenue Fund.
32          2. For fiscal year 2004-2005 and thereafter, the first $1
33    million of all additional fines and surcharges collected
34    annually pursuant to s. 318.1225 and s. 322.287 shall be
35    distributed to MADD Florida. The remaining funds shall be
36    distributed to the General Revenue Fund.
37          (b) For fiscal year 2004-2005 and thereafter, from the
38    funds remitted to the General Revenue Fund pursuant to s.
39    318.1225 and s. 322.287, and s. 318.14(5) and s. 318.18(13) if
40    created:
41          1. An amount as provided in the general appropriations act
42    shall be transferred to the Biomedical Research Trust Fund in
43    the Department of Health established under s. 20.435.
44          2. Twenty-five million dollars shall be transferred to the
45    Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer’s Research,
46    contingent upon the creation of the trust fund by July 1, 2004.
