16          Section . Subsections (13) and (14) are added to section
17    318.21, Florida Statutes, to read:
18          318.21 Disposition of civil penalties by county
19    courts.--All civil penalties received by a county court pursuant
20    to the provisions of this chapter shall be distributed and paid
21    monthly as follows:
22          (13)(a)1. For fiscal year 2003-2004, the first $1 million
23    of all additional fines and surcharges collected pursuant to s.
24    318.1225 and s. 322.287 shall be distributed to MADD Florida.
25    Contingent upon the enactment of legislation during the 2003
26    Regular Session of the Legislature requiring a study by the
27    department of the effects of aging on driving ability and the
28    creation of an advisory council for that purpose, the next $1
29    million shall be distributed to the department to fund the study
30    and the creation and operation of the advisory council. The
31    remaining funds resulting from the additional fines and
32    surcharges shall be distributed to the General Revenue Fund.
33          2. For fiscal year 2004-2005 and thereafter, the first $1
34    million of all additional fines and surcharges collected
35    annually pursuant to s. 318.1225 and s. 322.287 shall be
36    distributed to MADD Florida. The remaining funds shall be
37    distributed to the General Revenue Fund.
38          (b) For fiscal year 2004-2005 and thereafter, from the
39    funds remitted to the General Revenue Fund pursuant to s.
40    318.1225 and s. 322.287, and s. 318.14(5) and s. 318.18(13) if
41    created:
42          1. An amount as provided in the general appropriations act
43    shall be transferred to the Biomedical Research Trust Fund in
44    the Department of Health established under s. 20.435.
45          2. Twenty-five million dollars shall be transferred to the
46    Johnnie Bryars, Sr., Trust Fund for Alzheimer’s Research,
47    contingent upon the creation of the trust fund by July 1, 2004.
48          (14) The additional fines and surcharges provided for
49
