1 A bill to be entitled
2         An act relating to driving privilege; providing a popular
3   name; creating s. 318.1225, F.S.; providing additional
4   charges for certain traffic violations; providing for
5   distribution of moneys collected; amending s. 318.21,
6   F.S.; revising provisions relating to disposition of civil
7   penalties by county courts; creating s. 322.287, F.S.;
8   providing additional fee for reinstatement of suspended
9   driving privilege; providing an effective date.

11         Be It Enacted by the Legislature of the State of Florida:
12         
13         Section 1.This act shall be known by the popular name the
14   "Slosberg and Simmons Safety Act."
15         Section 2. Section 318.1225, Florida Statutes, is created
16   to read:
17         318.1225 Additional charges for
18   violation.--Notwithstanding s. 318.121 and in addition to the
19   stated fines in s. 318.18, the court shall impose an additional
20   $50 for all moving and nonmoving traffic infractions to be
21   distributed as follows:
22         (1) One dollar shall be remitted to the Department of
23   Revenue to be distributed to MADD Florida, to be used to fund
24   local victim services and education and awareness programs in
25   the state. The total amount distributed to MADD Florida under
26   this subsection shall not exceed $1 million per year. Any amount
27   collected in excess of $1 million shall be deposited into the
28   General Revenue Fund.
29         (2) Forty-nine dollars shall be remitted to the Department
30   of Revenue to be deposited into the General Revenue Fund.
31         Section 3. Subsection (13) is added to section 318.21,
32   Florida Statutes, to read:
33         318.21 Disposition of civil penalties by county
34   courts.--All civil penalties received by a county court pursuant
35   to the provisions of this chapter shall be distributed and paid
36   monthly as follows:
37         (13) The additional charges on moving and nonmoving
38   traffic violations provided for under s. 318.1225 must be
39   collected and distributed by the clerk of the court as provided
40   in that section.
41         Section 4. Section 322.287, Florida Statutes, is created
42   to read:
43         322.287 Reinstatement fees.--
44         (1) In addition to any other fines, fees, or charges
45   imposed, the department shall impose an additional $50 fee for
46   reinstating and returning a license suspended pursuant to s.
47   322.27.
48         (2) In addition to any other fines, fees, or charges
49   imposed, the department shall impose an additional $500 fee for
50   reinstating and returning a license suspended pursuant to s.
51   322.2615 or s. 322.2616.
52         (3) No driving privileges shall be reinstated until
53   complete payment of the applicable fees under this section.
54         (4) All moneys collected pursuant to this section shall be
55   deposited into the General Revenue Fund.
56         Section 5. This act shall take effect October 1, 2003.
