11          An act relating to driving privilege; providing a popular
12    name; creating s. 318.1225, F.S.; providing additional
13    charges for certain traffic violations; providing for
14    distribution of moneys collected; amending s. 318.21,
15    F.S.; revising provisions relating to disposition of civil
16    penalties by county courts; creating s. 322.287, F.S.;
17    providing additional fees for reinstatement of suspended
18    driving privilege; providing for distribution of moneys
19    collected; providing an effective date.

21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. This act shall be known by the popular name the
24    "Slosberg and Simmons Safety Act."
25          Section 2. Section 318.1225, Florida Statutes, is created
26    to read:
27          318.1225 Additional charges for violation.--
28          (1) Notwithstanding s. 318.121 and in addition to the
29    stated fines in s. 318.18, the court shall impose an additional
30    $25 for all moving violations and an additional $10 for all
31    nonmoving violations.
32          (2) Notwithstanding s. 318.121 and in addition to any
33    other fines imposed, the court shall impose an additional $500
34    for any person who violates s. 316.027(1).
35          (3) Notwithstanding s. 318.121 and in addition to any
36    other fines imposed, the court shall impose a surcharge of $500
37    on any fine imposed pursuant to s. 316.192 or s. 316.193.
38          (4)(a) For fiscal year 2003-2004, the first $1 million of
39    all additional fines and surcharges collected pursuant to this
40    section and s. 322.287 shall be distributed to MADD Florida.
41    Contingent upon the enactment of legislation during the 2003
42    Regular Session of the Legislature requiring a study by the
43    department of the effects of aging on driving ability and the
44    creation of an advisory council for that purpose, the next $1
45    million shall be distributed to the department to fund the study
46    and the creation and operation of the advisory council. The
47    remaining funds resulting from the additional fines and
48    surcharges shall be distributed to the General Revenue Fund.
49          (b) For fiscal year 2004-2005 and thereafter, the first $1
50    million of all additional fines and surcharges collected
51    annually pursuant to this section and s. 322.287 shall be
52    distributed to MADD Florida. Contingent upon the enactment of
53    legislation during the 2003 Regular Session of the Legislature
54    requiring a study by the department of the effects of aging on
55    driving ability and the creation of an advisory council for that
56    purpose, the next $1 million shall be distributed to the
57    department to fund the study and the creation and operation of
58    the advisory council. The remaining funds resulting from the
59    additional fines and surcharges shall be distributed equally
60    between the Biomedical Research Trust Fund and the Johnny Bryars
61    Byrd, Sr., Trust Fund for Alzheimer's Research as follows:
62          1. Effective July 1, 2004, up to $25 million shall be
63    remitted annually to the Biomedical Research Trust Fund in the
64    Department of Health established under s. 20.435.
65          2. Effective July 1, 2004, up to $25 million shall be
66    remitted annually to the Johnny Bryars Byrd, Sr., Trust Fund for
67    Alzheimer's Research, contingent upon the creation of the trust
68    fund by July 1, 2004.
69          3. Funds collected pursuant to this section that are not
70    distributed to MADD Florida, the department for the purpose of
71    funding a study on the effects of aging on driving ability and
72    an advisory council, the Biomedical Research Trust Fund, or the
73    Johnny Bryars Byrd, Sr., Trust Fund for Alzheimer's Research
74    shall be deposited into the General Revenue Fund.
75          Section 3. Subsection (13) is added to section 318.21,
76    Florida Statutes, to read:
77          318.21 Disposition of civil penalties by county
78    courts.--All civil penalties received by a county court pursuant
79    to the provisions of this chapter shall be distributed and paid
80    monthly as follows:
81          (13) The additional fines and surcharges provided for
82    under s. 318.1225 must be collected and distributed by the clerk
83    of the court as provided in that section.
84          Section 4. Section 322.287, Florida Statutes, is created
85    to read:
86          322.287 Reinstatement fees.--
87          (1) In addition to any other fines, fees, or charges
88    imposed, the department shall impose an additional $50 fee for
89    reinstating and returning a license suspended pursuant to s.
90    322.27.
91          (2) In addition to any other fines, fees, or charges
92    imposed, the department shall impose an additional $500 fee for
93    reinstating and returning a license suspended pursuant to s.
94    322.2615 or s. 322.2616.
95          (3) No driving privileges shall be reinstated until
96    complete payment of the applicable fees under this section.
97          (4) All moneys collected pursuant to this section shall be
98    distributed in the manner provided in s. 318.1225.
99          Section 5. This act shall take effect October 1, 2003.
