12          An act relating to driving privilege; providing a popular
13    name; creating s. 318.1225, F.S.; providing additional
14    charges for certain traffic violations; providing for
15    distribution of moneys collected; amending s. 318.21,
16    F.S.; revising provisions relating to disposition of civil
17    penalties by county courts; creating s. 322.287, F.S.;
18    providing additional fees for reinstatement of suspended
19    driving privilege; providing for distribution of moneys
20    collected; providing an effective date.

22          Be It Enacted by the Legislature of the State of Florida:
23         
24          Section 1. This act shall be known by the popular name the
25    "Slosberg and Simmons Safety Act."
26          Section 2. Section 318.1225, Florida Statutes, is created
27    to read:
28          318.1225 Additional charges for violation.--
29          (1) Notwithstanding s. 318.121 and in addition to the
30    stated fines in s. 318.18, the court shall impose an additional
31    $25 for all moving violations and an additional $10 for all
32    nonmoving violations.
33          (2) Notwithstanding s. 318.121 and in addition to any
34    other fines imposed, the court shall impose an additional $500
35    for any person who violates s. 316.027(1).
36          (3) Notwithstanding s. 318.121 and in addition to any
37    other fines imposed, the court shall impose a surcharge of $500
38    on any fine imposed pursuant to s. 316.192, s. 316.193, or s.
39    316.1935.
40          (4)(a) For fiscal year 2003-2004, the first $1 million of
41    all additional fines and surcharges collected pursuant to this
42    section and s. 322.287 shall be distributed to MADD Florida.
43    Contingent upon the enactment of legislation during the 2003
44    Regular Session of the Legislature requiring a study by the
45    department of the effects of aging on driving ability and the
46    creation of an advisory council for that purpose, the next $1
47    million shall be distributed to the department to fund the study
48    and the creation and operation of the advisory council. The
49    remaining funds resulting from the additional fines and
50    surcharges shall be distributed to the General Revenue Fund.
51          (b) For fiscal year 2004-2005 and thereafter, the first $1
52    million of all additional fines and surcharges collected
53    annually pursuant to this section and s. 322.287 shall be
54    distributed to MADD Florida. Contingent upon the enactment of
55    legislation during the 2003 Regular Session of the Legislature
56    requiring a study by the department of the effects of aging on
57    driving ability and the creation of an advisory council for that
58    purpose, the next $1 million shall be distributed to the
59    department to fund the study and the creation and operation of
60    the advisory council. The remaining funds resulting from the
61    additional fines and surcharges shall be distributed equally
62    between the Biomedical Research Trust Fund and the Johnny Bryars
63    Byrd, Sr., Trust Fund for Alzheimer's Research as follows:
64          1. Effective July 1, 2004, up to $25 million shall be
65    remitted annually to the Biomedical Research Trust Fund in the
66    Department of Health established under s. 20.435.
67          2. Effective July 1, 2004, up to $25 million shall be
68    remitted annually to the Johnny Bryars Byrd, Sr., Trust Fund for
69    Alzheimer's Research, contingent upon the creation of the trust
70    fund by July 1, 2004.
71          3. Funds collected pursuant to this section that are not
72    distributed to MADD Florida, the department for the purpose of
73    funding a study on the effects of aging on driving ability and
74    an advisory council, the Biomedical Research Trust Fund, or the
75    Johnny Bryars Byrd, Sr., Trust Fund for Alzheimer's Research
76    shall be deposited into the General Revenue Fund.
77          Section 3. Subsection (13) is added to section 318.21,
78    Florida Statutes, to read:
79          318.21 Disposition of civil penalties by county
80    courts.--All civil penalties received by a county court pursuant
81    to the provisions of this chapter shall be distributed and paid
82    monthly as follows:
83          (13) The additional fines and surcharges provided for
84    under s. 318.1225 must be collected and distributed by the clerk
85    of the court as provided in that section.
86          Section 4. Section 322.287, Florida Statutes, is created
87    to read:
88          322.287 Reinstatement fees.--
89          (1) In addition to any other fines, fees, or charges
90    imposed, the department shall impose an additional $50 fee for
91    reinstating and returning a license suspended pursuant to s.
92    322.27.
93          (2) In addition to any other fines, fees, or charges
94    imposed, the department shall impose an additional $500 fee for
95    reinstating and returning a license suspended pursuant to s.
96    322.2615 or s. 322.2616.
97          (3) No driving privileges shall be reinstated until
98    complete payment of the applicable fees under this section.
99          (4) All moneys collected pursuant to this section shall be
100    distributed in the manner provided in s. 318.1225.
101          Section 5. This act shall take effect October 1, 2003.
