11          An act relating to driving privilege; providing a popular
12    name; creating s. 318.1225, F.S.; providing additional
13    charges for certain traffic violations; providing for
14    distribution of moneys collected; amending s. 318.21,
15    F.S.; revising provisions relating to disposition of civil
16    penalties by county courts; creating s. 322.287, F.S.;
17    providing additional fees for reinstatement of suspended
18    driving privilege; providing for distribution of moneys
19    collected; providing an effective date.

21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. This act shall be known by the popular name the
24    "Slosberg and Simmons Safety Act."
25          Section 2. Section 318.1225, Florida Statutes, is created
26    to read:
27          318.1225 Additional charges for violation.--
28          (1) Notwithstanding s. 318.121 and in addition to the
29    stated fines in s. 318.18, the court shall impose an additional
30    $25 for all moving violations and an additional $10 for all
31    nonmoving violations.
32          (2) Notwithstanding s. 318.121 and in addition to any
33    other fines imposed, the court shall impose an additional $500
34    for any person who violates s. 316.027(1).
35          (3) Notwithstanding s. 318.121 and in addition to any
36    other fines imposed, the court shall impose a surcharge of $500
37    on any fine imposed pursuant to s. 316.192, s. 316.193, or s.
38    316.1935.
39          (4)(a) For fiscal year 2003-2004, the first $1 million of
40    all additional fines and surcharges collected pursuant to this
41    section and s. 322.287 shall be distributed to MADD Florida.
42    Contingent upon the enactment of legislation during the 2003
43    Regular Session of the Legislature requiring a study by the
44    department of the effects of aging on driving ability and the
45    creation of an advisory council for that purpose, the next $1
46    million shall be distributed to the department to fund the study
47    and the creation and operation of the advisory council. The
48    remaining funds resulting from the additional fines and
49    surcharges shall be distributed to the General Revenue Fund.
50          (b) For fiscal year 2004-2005 and thereafter, the first $1
51    million of all additional fines and surcharges collected
52    annually pursuant to this section and s. 322.287 shall be
53    distributed to MADD Florida. Contingent upon the enactment of
54    legislation during the 2003 Regular Session of the Legislature
55    requiring a study by the department of the effects of aging on
56    driving ability and the creation of an advisory council for that
57    purpose, the next $1 million shall be distributed to the
58    department to fund the study and the creation and operation of
59    the advisory council. The remaining funds shall be distributed
60    as follows:
61          1. Twenty-five million dollars shall be remitted annually
62    to the Biomedical Research Trust Fund in the Department of
63    Health established under s. 20.435.
64          2. Twenty-five million dollars shall be remitted annually
65    to the Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer’s
66    Research, contingent upon the creation of the trust fund by July
67    1, 2004.
68          3. All other funds shall be deposited in the General
69    Revenue Fund.
70          Section 3. Subsection (13) is added to section 318.21,
71    Florida Statutes, to read:
72          318.21 Disposition of civil penalties by county
73    courts.--All civil penalties received by a county court pursuant
74    to the provisions of this chapter shall be distributed and paid
75    monthly as follows:
76          (13) The additional fines and surcharges provided for
77    under s. 318.1225 must be collected and distributed by the clerk
78    of the court as provided in that section.
79          Section 4. Section 322.287, Florida Statutes, is created
80    to read:
81          322.287 Reinstatement fees.--
82          (1) In addition to any other fines, fees, or charges
83    imposed, the department shall impose an additional $50 fee for
84    reinstating and returning a license suspended pursuant to s.
85    322.27.
86          (2) In addition to any other fines, fees, or charges
87    imposed, the department shall impose an additional $500 fee for
88    reinstating and returning a license suspended pursuant to s.
89    322.2615 or s. 322.2616.
90          (3) No driving privileges shall be reinstated until
91    complete payment of the applicable fees under this section.
92          (4) All moneys collected pursuant to this section shall be
93    distributed in the manner provided in s. 318.1225.
94          Section 5. This act shall take effect October 1, 2003.
