1 A bill to be entitled
2          An act relating to driving privilege; providing a popular
3    name; creating s. 318.1225, F.S.; providing additional
4    charges for certain traffic violations; providing for
5    distribution of moneys collected; amending s. 318.21,
6    F.S.; revising provisions relating to disposition of civil
7    penalties by county courts; creating s. 322.287, F.S.;
8    providing additional fees for reinstatement of suspended
9    driving privilege; amending s. 318.1215, F.S.; clarifying
10    that funds be used for driver education programs in
11    schools; requiring that funds be used for enhancement of
12    driver education program funds; providing a requirement
13    for behind-the-wheel training; providing an effective
14    date.

16          Be It Enacted by the Legislature of the State of Florida:
17         
18          Section 1. This act shall be known by the popular name the
19    "Slosberg and Simmons Safety Act."
20          Section 2. Section 318.1225, Florida Statutes, is created
21    to read:
22          318.1225 Additional charges for violation.--
23          (1) Notwithstanding s. 318.121 and in addition to the
24    stated fines in s. 318.18, there is hereby imposed an additional
25    $50 for all moving violations and an additional $20 for all
26    nonmoving violations.
27          (2) Notwithstanding s. 318.121 and in addition to any
28    other fines imposed, there is hereby imposed an additional $500
29    for any person who violates s. 316.027(1).
30          (3) Notwithstanding s. 318.121 and in addition to any
31    other fines imposed, there is hereby imposed a surcharge of $500
32    on any fine imposed pursuant to s. 316.192, s. 316.193, or s.
33    316.1935.
34          Section 3. Subsections (13) and (14) are added to section
35    318.21, Florida Statutes, to read:
36          318.21 Disposition of civil penalties by county
37    courts.--All civil penalties received by a county court pursuant
38    to the provisions of this chapter shall be distributed and paid
39    monthly as follows:
40          (13)(a)1. For fiscal year 2003-2004, the first $1 million
41    of all additional fines and surcharges collected pursuant to s.
42    318.1225 and s. 322.287 shall be distributed to MADD Florida.
43    Contingent upon the enactment of legislation during the 2003
44    Regular Session of the Legislature requiring a study by the
45    department of the effects of aging on driving ability and the
46    creation of an advisory council for that purpose, the next $1
47    million shall be distributed to the department to fund the study
48    and the creation and operation of the advisory council. The
49    remaining funds resulting from the additional fines and
50    surcharges shall be distributed to the General Revenue Fund.
51          2. For fiscal year 2004-2005 and thereafter, the first $1
52    million of all additional fines and surcharges collected
53    annually pursuant to s. 318.1225 and s. 322.287 shall be
54    distributed to MADD Florida. The remaining funds shall be
55    distributed to the General Revenue Fund.
56          (b) For fiscal year 2004-2005 and thereafter, from the
57    funds remitted to the General Revenue Fund pursuant to s.
58    318.1225 and s. 322.287, and s. 318.14(5) and s. 318.18(13) if
59    created:
60          1. An amount as provided in the general appropriations act
61    shall be transferred to the Biomedical Research Trust Fund in
62    the Department of Health established under s. 20.435.
63          2. Twenty-five million dollars shall be transferred to the
64    Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer’s Research,
65    contingent upon the creation of the trust fund by July 1, 2004.
66          (14) The additional fines and surcharges provided for
67    under s. 318.1225 must be collected and distributed by the clerk
68    of the court as provided in that section.
69          Section 4. Section 322.287, Florida Statutes, is created
70    to read:
71          322.287 Reinstatement fees.--
72          (1) In addition to any other fines, fees, or charges
73    imposed, the department shall impose an additional $50 fee for
74    reinstating and returning a license suspended pursuant to s.
75    322.27.
76          (2) In addition to any other fines, fees, or charges
77    imposed, the department shall impose an additional $500 fee for
78    reinstating and returning a license suspended pursuant to s.
79    322.2615 or s. 322.2616.
80          (3) No driving privileges shall be reinstated until
81    complete payment of the applicable fees under this section.
82          Section 5. Section 318.1215, Florida Statutes, is amended
83    to read:
84          318.1215 Dori Slosberg Driver Education Safety
85    Act.--Effective October 1, 2002, notwithstanding the provisions
86    of s. 318.121, a board of county commissioners may require, by
87    ordinance, that the clerk of the court collect an additional $3
88    with each civil traffic penalty, which shall be used to fund
89    drivertrafficeducation programs in public and nonpublic
90    schools. The ordinance shall provide for the board of county
91    commissioners to administer the funds, which shall be used for
92    enhancement, and not replacement, of driver education program
93    funds. The funds shall be used for direct educational expenses
94    and shall not be used for administration. Each driver education
95    program receiving funds pursuant to this section shall require
96    that a minimum of 30 percent of a student's time in the program
97    shall be behind-the-wheel training.This section may be cited as
98    the "Dori Slosberg Driver Education Safety Act."
99          Section 6. This act shall take effect October 1, 2003.
