1 A bill to be entitled
2 An act relating to unclaimed court-ordered
3 payments; amending s. 945.31, F.S.; authorizing
4 the Department of Corrections to deposit or
5 transfer into the General Revenue Fund certain
6 overpayments and other payments; repealing s.
7 960.0025, F.S., relating to the allocation of
8 certain funds from restitution or other
9 court-ordered payments; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 945.31, Florida Statutes, is
15 amended to read:
16 945.31 Restitution and other payments.--The department
17 may establish bank accounts outside the State Treasury for the
18 purpose of collecting and disbursing restitution and other
19 court-ordered payments from persons in its custody or under
20 its supervision, and may collect an administrative processing
21 fee in an amount equal to 4 percent of the gross amounts of
22 such payments. Such administrative processing fee shall be
23 deposited in the department's Operating Trust Fund and shall
24 be used to offset the cost of the department's services. The
25 department may also deposit or transfer into the General
26 Revenue Fund offender overpayments that are less than $10 at
27 the end of the offender's supervision; offender funds that are
28 not claimed within 1 year after supervision is terminated;
29 victim restitution payments that are not claimed within 1 year
30 after the offender's supervision is terminated to the General
31 Revenue Fund to fund victim programs or the automated victim

1 and information and notification programs; interest earned on
2 balances in the COPS bank accounts; and payments that cannot
3 be identified and are not claimed within 1 year after they are
4 received.
5 Section 2. Section 960.0025, Florida Statutes, is
6 repealed.
7 Section 3. This act shall take effect upon becoming a
8 law.
