14          Amendment (with title amendment)
15          Between lines 328-329, insert:
16          Section 1. Subsection (4) of section 465.0265, Florida
17    Statutes, is renumbered as subsection (5) and a new subsection
18    (4) is added to said section, to read:
19          465.0265 Centralized prescription filling.--
20          (4) Pharmacies accessing the same prescription records in
21    a centralized database or pharmacy computers linked in any other
22    manner may refill or dispense prescriptions at the request of
23    another pharmacy so linked, provided that the pharmacies have
24    the same owner or have a written contract specifying the
25    services to be provided by each pharmacy, the responsibilities
26    of each pharmacy, and the manner in which the pharmacies will
27    comply with federal and state laws, rules, and regulations.
28    Prescriptions refilled or dispensed using such a system shall
29    not be considered prescription transfers or copies provided the
30    computer system registers a complete and full audit trail of all
31    activities and includes the identification of the pharmacies and
32    pharmacists accessing the centralized database, and provided
33    that the system restricts access to the computerized
34    prescription records to pharmacies or other authorized
35    personnel.
